A. 
There is hereby created the office of Borough Clerk which shall be filled by appointment of the Mayor with the consent of the Council for a three-year term. In the event of a vacancy in the office of Borough Clerk, an appointment shall be made for a new term and not for an unexpired term. Any appointment to fill a vacancy in the position of Borough Clerk shall be made within six months after the office becomes vacant.
B. 
The Borough Clerk shall be entitled to acquire tenure in that position in accordance with Title 40A of the New Jersey Statutes Annotated.
C. 
In order to serve as Borough Clerk, a person must be at least 21 years of age, a citizen of the United States, of good moral character, have obtained a certificate of diploma issued after at least four years of study from an approved secondary school or as otherwise provided by law, and shall have satisfied the requirements for certification pursuant to Title 40A of the New Jersey Statutes Annotated.
The Borough Clerk shall:
A. 
Act as secretary of the Borough and custodian of the Borough Seal and of all minutes, books, deeds, bonds, contracts and archival records of the Borough;
B. 
Act as secretary for the Mayor and Council, prepare meeting agendas at the discretion of the Mayor and/or the Council President, be present at all meetings of the Mayor and Council, keep a journal of the proceedings of every meeting, retain the originals of all ordinances and resolutions, and record the minutes of every meeting of the Mayor and Council;
C. 
Serve as the chief administrative officer for all elections held in the Borough subject to the requirements of Title 19 of the New Jersey Statutes Annotated;
D. 
Serve as chief registrar of voters in the Borough subject to the requirements of Title 19 of the New Jersey Statutes Annotated;
E. 
Serve as the administrative officer responsible for the acceptance of applications for licenses and permits and the issuance of licenses and permits, except where such duties are otherwise delegated by statute or this Code;
F. 
Serve as coordinator and records manager responsible for implementing local archives and records retention programs as mandated by Title 47 of the New Jersey Statutes Annotated;
G. 
Open and present to the Mayor and Council all correspondence addressed to them and answer such correspondence in accordance with the direction of the Mayor and Council;
H. 
Receive and file in the Borough Clerk's office all oaths and affirmations of office, decrees, insurance policies, leases and all other papers affecting Borough property or Borough affairs;
I. 
Superintend the advertising of all ordinances; and
J. 
Perform such other duties as are now or hereafter imposed by statute, regulation, this Code, and/or at the direction of the Mayor and/or Council.
A. 
The office of Deputy Borough Clerk is hereby created. The Deputy Borough Clerk shall be appointed by the Mayor with the consent of the Council for a term beginning January 1 of each year and ending December 31 of the same year or until his/her successor has been appointed.
B. 
The Deputy Borough Clerk is to perform, in the absence of the Borough Clerk, the duties required by state statute and this Code to be performed by the Borough Clerk. In the absence or disability of the Borough Clerk, the Deputy Borough Clerk shall have all the powers of the Borough Clerk and shall perform the functions and duties of such office.
C. 
The Deputy Borough Clerk shall assist the Borough Clerk in the performance of his/her duties as Borough Clerk and perform such duties as are designated by and under the direction of the Borough Clerk, attend such meetings of the various boards, agencies, departments, and committees of the Borough as the Clerk may designate, take the minutes of the meetings thereof, and generally perform such duties as the Borough Clerk, the Mayor and/or Council may, from time to time, designate.
