Editor's Note: This ordinance superseded former Ch. 14, Burgdorff Cultural Center, which was comprised of Art. I, Board of Trustees, adopted 10-4-1994 by Ord. No. 1953, as amended, and Art. II, ArtsMaplewood Commission, adopted 12-6-1994 by Ord. No. 1956. The titles of these articles have been retained for organizational purposes.
The land and improvements thereon, commonly known as 12 Durand Road, Block 12-1, Lot 100A, Maplewood, New Jersey, granted to the Township of Maplewood by deed dated October 15, 1988, shall constitute and be named the Burgdorff Center for the Performing Arts.
A Board of Trustees is hereby established to oversee and administer the Burgdorff Center for the Performing Arts in accordance with the purposes of the Burgdorff Center for the Performing Arts as set forth in the introductory paragraph to this article. The Board of Trustees shall consist of seven members.
A. 
A member of the Burgdorff family for as long as such individual resides in the New York/New Jersey metropolitan area.
B. 
A member of the civic group, The Strollers, for as long as such civic group continues to exist.
C. 
The Mayor of the Township of Maplewood.
D. 
A member of the Maplewood Township Committee to be selected by the Township Committee annually.
E. 
A resident of the Township of Maplewood to be appointed by the Township Committee annually.
F. 
The Township Administrator.
G. 
The Chairperson of ArtsMaplewood.
The Board of Trustees shall have as its Chairperson the Mayor of the Township of Maplewood. The Vice Chairperson shall be the Vice Mayor of the Township of Maplewood.
The Board of Trustees shall establish such committees as it deems necessary for the proper administration and operation of the Burgdorff Center for the Performing Arts.
The Board of Trustees of the Burgdorff Center for the Performing Arts shall meet at least once per year.
Income derived from use of the facilities and from donations shall be deposited through the Department of Recreation, Parks and Cultural Affairs by the Township Treasurer in the Recreation Trust Fund and shall be dedicated for the benefit of the Burgdorff Center for the Performing Arts. Surplus funds, if any, may, at the discretion of the Township Committee, be paid into the general fund of the Township. Expenditures and disbursements shall be requested through the Department of Recreation, Parks and Cultural Affairs and made by the Township Treasurer in accordance with statutory procedure and municipal regulation.
The Board of Trustees shall keep records of its meetings, activities and finances and shall report annually to the Township Committee.
The Board of Trustees shall endeavor to ensure full cooperation and coordination of its activities and plans with all other organizations of the Township of Maplewood dedicated to the pursuit of the artistic, cultural, dance, dramatic, historical, musical, poetic and other activities of interest that may benefit the community and that are appropriate for the facilities of the Burgdorff Center for the Performing Arts.[1]
