Editor's Note: This local law also provided as follows: “Please take notice to the extent that this local law may conflict with applicable portions of the Town Law of the State of New York, it is the stated intention of the Town to exercise its authority to supersede and amend, as granted under the Municipal Home Rule Law of the State of New York, Section 10. The Town hereby provides notice that it is exercising its authority to supersede and amend pursuant to Municipal Home Rule Law of the State of New York Section 22.”
Pursuant to § 20, Subdivision 1(b), of the Town Law of the State of New York, the Town Board of the Town of Deerpark is hereby authorized to appoint not more than four civil officers for the Town. Said officers shall possess all of the powers and duties of constables in civil actions and proceedings, only, and shall be paid no salary by the Town Board but shall be entitled to collect the statutory fees allowed by law in such civil actions and proceedings. The civil officers of the Town shall have all of the authority conveyed upon than by the various laws of the State of New York and the Town of Deerpark.
The authority of a civil officer shall extend to civil actions and proceedings only. Civil officers of the Town shall have authority to carry out the orders of the Local Justice Courts of the Town of Deerpark as well as courts of the County of Orange and the State of New York. Civil officers shall have the authority to serve process and to complete a summary proceeding and eviction in landlord/tenant matters pursuant to a court order. A civil officer shall have the power to save and execute the processes and mandates of a local, county and state courts.
