A.
The Town of Deerpark Planning Board shall have the
power to approve preliminary plats within the Town of Deerpark, outside
the limits of any incorporated city or village, in accordance with
the requirements of §§ 276, 277 and 278, Article 16
of the Town Law, as amended.
B.
This authority supplements the authority to approve
plats granted the Planning Board by resolution of September 7, 1960.
The Town Clerk shall file with the Clerk of
the County of Orange a certificate, certifying that said Planning
Board has been authorized to review and approve preliminary plats
as well as final plats for new subdivisions of land in the Town of
Deerpark in accordance with §§ 276, 277 and 278, Article
16, as amended, of the Town Law.

The Town Board shall supersede the New York State Town Law pursuant
to the Municipal Home Rule Law and may, during the annual reorganization
meeting of the Town Board, or as soon thereafter as practicable, appoint
an alternate member or members of the Planning Board to serve for
a term of one year or until a successor is appointed. Such alternate
members shall attend meetings and act in the capacity of a full member
whenever regular members cannot attend or must recuse themselves due
to conflicts of interest. Alternate members shall not participate
in the Board’s deliberation of any matter in which they are
not called upon to act in replacement of a regular member.
