The wharf area at Packett's Landing Canal Park, between the Main Street Bridge and the Parker Street Bridge over the Barge Canal, is reserved for transient boat usage not to exceed 48 hours. No boat may tie up to the wharf for any time exceeding two periods of 48 consecutive hours during any thirty-day period, except tour boats with permission of the Village Administrator or the Village Clerk.

The park will be closed at 10:00 p.m. to those who do not have a boat tied up on the wharf.
Any person violating any of the provisions of this chapter shall be liable for and forfeit and pay a penalty not exceeding $25 for each offense. Each day that a violation exists shall constitute a new and separate offense.
A. 
Any Fairport Village police officer, Monroe County Sheriff's Deputy or any appointed employee of the Village of Fairport shall have the authority to issue and serve an appearance ticket pursuant to the Criminal Procedure Law for any violation hereof. If an appearance ticket is issued, an answer to such appearance ticket may be made by registered or certified mail, return receipt requested, within five days of the violation, as provided in Subsections B and C of this section, in lieu of personal appearance on the return date at the time and court specified in said appearance ticket.
B. 
If a person charged with the violation admits to the violation as charged in the appearance ticket, such person may complete the answer form hereby authorized by this section and forward such form and appearance ticket to the office specified on such appearance ticket, with a check or money order in the amount of $25 for the violation charged.
C. 
If the person charged with the violation denies part or all of the violation as charged in the appearance ticket, such person may complete the form likewise prescribed for that purpose and forward such form and appearance ticket, together with security in the amount of $25, to the office specified on such appearance ticket. Upon receipt, such answer shall be entered and a new return date established by said office. Such person shall be notified by return mail of the date and place of such return date, and the security shall be returned upon appearance thereat. If a person shall fail to appear at a return date when such is provided for pursuant to this section, the security posted to secure such appearance shall be forfeited and a summons or a warrant of arrest may be issued pursuant to the Criminal Procedure Law.
