The City of Oneonta is subject to the Act of Congress known as the "Americans With Disabilities Act of 1990," found in 42 U.S.C. § 12101 et seq. The goal of equal access is the intention and stated policy of the City of Oneonta. Such goals can be furthered by the creation of an Americans With Disabilities Act Compliance Committee, hereinafter known as the "ADA Compliance Committee."
There is created an ADA Compliance Committee, an advisory committee of the city. This Committee shall consist of three members, at least one of which shall be a person with disabilities covered by the Americans With Disabilities Act. Members shall be appointed by the Mayor with the approval of the Common Council. Members shall serve for one-year terms and may be reappointed to subsequent terms.
The Committee shall meet upon no less than seven days' notice of the ADA Coordinator. The Committee shall elect a Chair from among the members for a one-year term. The Committee shall adopt rules and procedures for its meetings. The Committee shall keep accurate records of its meetings and activities.
The powers and duties of the Board shall be to:
A. 
Review and seek to resolve complaints on ADA compliance, as provided in Title II of the Americans With Disabilities Act.
B. 
Serve as the appeal committee in cases where reasonable accommodation has been requested, but the plaintiff wishes to appeal the city's planned accommodation.
C. 
Advise the Common Council of Committee actions and make recommendations for additional compliance activities. Such recommendations shall be made in writing to the Mayor at least once a year to coincide with budget preparation.
The members of the Committee will serve without compensation.
