The Common Council of the City of Oneonta, New York, recognizes that emergency work situations arise which require full-time permanently appointed employees of the City of Oneonta to be near their place of work and to assume the continuation of emergency services to protect the health, safety and general welfare of the people. Through the adoption of this article, the Common Council of the City of Oneonta makes a legislative determination that those who reside within a designated residency region are more available for callback in emergency situations than those that reside at more substantial distances from the City of Oneonta. The Common Council of the City of Oneonta further declares that such a quality is desirable for full-time permanently appointed employees who perform emergency services. The Common Council of the City of Oneonta considers that such employees must be available to respond to emergency situations and to assure continuation of essential services. It is further determined by the Common Council of the City of Oneonta that the public need is sufficient to require that full-time permanently appointed employees, hired after the effective date of this article, reside at such a distance from the City of Oneonta so as to be able to reach emergency work sites within a legislatively determined time limit.
A. 
The Common Council of the City of Oneonta hereby establishes a residency requirement for all members of the Fire Department of the City of Oneonta. Every person employed as a full-time, part-time or call member of the Fire Department of the City of Oneonta on or after the effective date of this article shall be a resident of the City of Oneonta, New York, or shall reside in the designated fire district, or shall reside within a five-mile radius from the fire station (such determination shall be made using a Global Positioning System starting from the fire station flag pole and going to the nearest boundary pin of the property line). Fire Department members shall become such a resident within six months of the date of initial service for the City of Oneonta. During the time of service with the Oneonta Fire Department, no member shall cease to be a resident of the City of Oneonta, the Fire District or within a five-mile radius from the fire station.
B. 
A copy of this article shall be provided to all members of the Fire Department upon being hired. However, the failure of the City of Oneonta to do so shall not affect the applicability of this article to any member of the Fire Department hired on or before its effective date.

Every person employed as a full-time permanently appointed member of the Public Works Department of the City of Oneonta on or after the effective date of this article shall reside within such a distance of the City of Oneonta so as to be able to reach the City of Oneonta within 1/2 of an hour of being called or shall so reside within six months of the date of permanent appointment. During the time of service of such members of the Public Works Department, no individual shall cease to reside within the designated residency region.
B. 
A copy of this article shall be provided to all members of the Public Works Department upon being hired. However, the failure of the City of Oneonta to do so shall not affect the applicability of this article to any full-time permanently appointed member of the Public Works Department hired after its effective date.

During the time of service of such members of the Water Department, no individual shall cease to reside within the designated residency region.

Every person employed as a full-time permanently appointed member of the Sewer Department of the City of Oneonta on or after the effective date of this article shall reside at such a distance from the City of Oneonta so as to be able reach the City of Oneonta within 1/2 hour of being called, or shall so reside within six months of the date of permanent appointment. During the time of service of such members of the Sewer Department, no individual shall cease to reside within the designated residency region.

However, the failure of the City of Oneonta to do so shall not affect the applicability of this article to any full-time permanently appointed member of the Sewer Department hired after its effective date.
