[HISTORY: Adopted by the Town Board of the

This chapter shall be known as the Bear Creek
Harbor Law.
The Ontario Town Board has determined that in
order to provide for the health, safety and welfare of the citizens
of the Town of Ontario and for the protection of users of Lake Road
in said Town, it is necessary to regulate actions and activities within
the boundaries of the area known as Bear Creek Harbor within said
Town.
As used in this chapter, the following terms
shall have the meanings indicated:
The water outlet from Bear Creek to Lake Ontario and all
land owned and designated by the Town of Ontario associated with recreation
and parks and located at Bear Creek on Lake Road in the Town of Ontario.
It shall further include all properties directly adjacent to the harbor
area itself owned by the Town of Ontario.
Any vehicle or craft used on the water, whether motorized
or nonmotorized.
Any device attached to a vehicle used to transport a boat.
Any highway vehicle used to transport a boat.
A written license issued by the Town Clerk of the Town of
Ontario authorizing launching of a boat at Bear Creek Harbor.
In accordance with the Vehicle and Traffic Law of the State
of New York, every device in, upon or by which any person or property
is or may be transported or drawn upon a highway, except devices moved
by human power or used exclusively upon stationary rails or tracks.
No person shall launch any boat from Bear Creek
Harbor unless such person has obtained and has in his/her possession,
a valid launch permit issued by the Town Clerk of the Town of Ontario.
If the boat is launched from a trailer attached to a vehicle, the
trailer shall display the current Town launch permit. In addition,
the vehicle towing such trailer must also display a current Town launch
permit. In the event that the boat is brought to the harbor by boat
carrier, the vehicle carrying such boat shall have prominently displayed
a current Town launch permit.
The fee for said launch permit will be as set
out in the Town of Ontario Fee Schedule.[1]

Except when in compliance with the law or directions
of a police officer or official traffic control device, no person
shall park a vehicle at Bear Creek Harbor except in a designated area.
All such areas shall be clearly marked by signs.
Handicapped parking shall be permitted in any
designated area. In order to park in handicapped designated parking,
a handicapped sticker must be prominently displayed.
No parking is permitted by vehicles with trailers
or boat carriers unless such vehicles have prominently displayed the
current Town launch permit.

No firearms and/or explosives shall be discharged
within Bear Creek Harbor.
B.ย
No dumping shall be permitted.
C.ย
No person shall operate a snowmobile or other off-road
vehicle on lands covered by this chapter. No vehicle shall be operated
except on designated roads within the harbor.
D.ย
No dogs or other animals shall be permitted in Bear
Creek Harbor area unless such dog or other animal is on a leash or
in a cage. No dogs or other animals shall be permitted in the portion
of Bear Creek Harbor known as โMemorial Point in Thompson Park,โ
at any time.

No person being the owner or the agent of the owner
of any dog shall permit such dog to commit any nuisance within Bear
Creek Harbor or to cause any nuisance or to cause damage to the person
or property of others.

Fishing is prohibited in Bear Creek Harbor while standing
or sitting within the boundaries of the highway right of way known
as "Lake Road, in the Town of Ontario, Wayne County, New York."
G.ย
The Director of Recreation and Parks is authorized
to issue rules and regulations governing conduct in Bear Creek Harbor
after Town Board approval.
A.ย
Upon conviction for a violation of any provision of
this chapter, the Court shall impose a sentence consisting of a fine
of not less than $50 nor more than $100 for the first offense and
a fine of not less than $100 nor more than $200 for each subsequent
offense.
B.ย
Nothing in this chapter shall operate to bar the enforcement
of any New York State ordinance or law.
The Director of Recreation and Parks is hereby
authorized to adopt rules and regulations subject to Town Board approval
to implement the provisions of this chapter.
