As used in this chapter, the following terms shall have the meanings
indicated:
The owner or operator of a motor vehicle.
Every New York State Trooper or Wayne County Deputy Sheriff or any
person authorized to direct or regulate traffic or to make arrests for violations
of traffic laws and regulations.
The stopping of a vehide, whether occupied or not, otherwise than
temporarily for the purpose of and while actually engaged in receiving or
discharging passengers.
No persons shall park a vehicle, whether occupied or not, on any sidewalk
within the Town of Ontario.

No parking shall be allowed from November 1 of each year to April 1
of the following year on the roads of the Town of Ontario between the hours
of 2:00 a.m. and 6:00 a.m.
No person shall park a vehicle:
A.
In front of a public or private driveway.
B.
Within 50 feet of a crosswalk at an intersection unless
a different distance is indicated by official signs, markings or parking meters.
C.
Within 30 feet upon the approach of any flashing signal,
stop or yield sign or traffic control signal located at the side of the roadway
unless a different distance is indicated by official signs, markings or parking
meters.
D.
Within 50 feet of any intersection unless a different
distance is indicated by official signs, markings or parking meters.
A.
The penalty for violating any provision of this chapter
shall be $25 for the first offense and $50 for each subsequent offense.
B.
Where applicable under and as provided by state law,
vehicles parked in violation of this chapter shall be impounded. They shall
be released to the owners by the Town Clerk upon payment of impoundage fees.

Except when necessary to avoid conflict with other traffic or when in
compliance with law or the directions of a police officer or official traffic
control device or when parking is authorized by reserved or other posted notice
as determined by resolution of the Ontario Town Board or except momentarily
to pick up or discharge a passenger or passengers, no person shall park a
vehicle on any highways in the Town of Ontario.

No person shall park a vehicle in a public parking lot in the Town of
Ontario unless such person shall be an owner, employee or customer of a business
establishment served by said parking lot, during the hours of operation of
such business, or for the receipt or discharge of passengers or merchandise.

During the period from November 1 of each year to April 15 of the following
year, alternate-night parking in public parking lots in the Town of Ontario
may be implemented by the Superintendent of Highways to facilitate snow removal,
and such restrictions shall be effective upon posting.

Designation of parking restrictions and time limits shall be made by
resolution of the Town Board as it may from time to time deem necessary to
enforce this chapter of the Town Code.

No person shall park a vehicle on property owned by the Town of Ontario
within 50 feet of Palmer Hall except as authorized by signs erected at the
direction of the Town Board.

A.
No person shall park or stand a motor vehicle in an area
or space designated as a fire lane unless directed to do so by a police officer.
This traffic regulation shall apply in places of pubic assembly and in any
parking area or driveway of the private property of a fire station or shopping
center. The Town of Ontario does hereby establish a fire lane of 20 feet in
width around the perimeter of the stores and buildings located in places of
public assembly and in shopping centers in the Town of Ontario and directs
that said perimeter be maintained and kept open at all times for the movement
of emergency vehicles and other traffic. The twenty-foot width shall be measured
from the curbline, if established or existing. If no curbing exists, then
the twenty-foot width for the fire lane shall be measured from the edge of
the building or buildings. When said fire lane shall conflict with setbacks
as defined by the Town of Ontario Zoning Ordinance[1] and/or property lines or other issues shall make the existence
of a fire lane as defined by this Code impracticable the Town of Ontario Code
Enforcement Officer shall determine the width and location of the fire lane.
Said fire lane shall be clearly marked with traffic control devices (signs)
every 50 feet notifying the pubic of said area's existence.
B.
All control devices (signs) mentioned herein shaft conform
with the New York State Manual of Uniform Traffic Control Devices.
C.
Signs shall be erected at the direction of the Code Enforcement
Officer of the Town of Ontario, and the expense of such signage shall be borne
by the property owner.

The provisions of this chapter shall apply to the stopping, standing and parking prohibitions at the following locations, each of which shall be known and designated as a tow-away zone. The provisions of this section shall be effective when the locations specified in § 102-12 hereof shall have been marked and designated by signs giving notice of the tow-away zone.

Upon the issuance by a police officer of a notice of parking violation or a notice of traffic infraction for the violation of any stopping, standing or parking prohibition at any of the locations set forth in §§ 102-2, 102-3, 102-4, 102-6, 102-7, 102-8, 102-10, 102-11 and 102-12 hereof, any police officer hereby is authorized to remove, or cause to be removed by the Town or the Town's authorized towing agent, and then store any such unattended and illegally stopped, standing or parked vehicle.

A.
No vehicle which is in the custody of the police or its
agent, the Town or the Town's authorized towing agent as a result of
having been removed pursuant to the provisions of this chapter shall be released
to the registered owner or authorized operator of such impounded vehicle unless
and until such owner or operator first shall have paid the following charges:
(1)
For removal, towing by any apparatus for removal, including
wheel-lift equipment but excluding a flatbed truck, and impounding, including
the first 24 hours of storage or any fraction thereof: $100.
(2)
For removal by flatbed truck and impounding, including
the first 24 hours of storage or any fraction thereof: $125.
(3)
For outside storage of the removed vehicle beginning
24 hours after the original impoundment: $10 per day or any fraction thereof.
(4)
For inside storage of the removed vehicle beginning 24
hours after the original impoundment: $25 per day or any fraction thereof.
(5)
An administrative service charge payable to the Town of Ontario in a sum as set forth in the Town of Ontario Fee Schedule approved by resolution of the Town Board and on file with the Town Clerk. This administrative service charge is in addition to the charges provided for in Subsection A(1) through (4) hereof.
B.
All the charges provided for in this section are in addition
to any other fees, fines or penalties which may be imposed by law due to the
illegal stopping, standing or parking of any vehicle.
