This chapter shall be known and may be cited as the "Sanitary Code of
the Town of Ontario."
This chapter shall be administered by the Town Clerk of the Town of
Ontario. Permits shall be issued by such officer after the same have been
granted by the Board of Health of the Town of Ontario as hereinafter provided.
A.
A permit issued by the Town Clerk pursuant to the provisions
of this chapter is issued to a particular individual, firm or corporation,
and, wherever used herein, the word "person" shall include firm or corporation.
Each permit shall be issued for a designated premises mentioned in the permit
and shall not be valid for use by any other person or at any place other than
that for which issued. Applications for permits shall be made to the Board
of Health upon official forms furnished for such purpose; shall be signed
by the applicant; shall be accompanied by a written report and recommendation
of the Health Officer or a duly authorized representative concerning the application;
and all information required by the Board of Health shall be fully stated
in the application.
B.
All permits shall be issued by the Town Clerk, upon order
of the Board of Health, after such permit shall have been granted by majority
vote of the Board of Health. A permit shall be valid for an indefinite period
until revoked or unless otherwise specified at the time of the granting of
the permit. The Board of Health, at the time of granting the permit or at
any time during which a permit may be outstanding, may require the holder
of the permit to give security by a written undertaking with one or more sureties
approved by the Board of Health, to the effect that she/he will obey the rules
and regulations of the Board of Health and the conditions of the permit issued
to her/him or that the sureties will pay the sum mentioned in the undertaking.
Every permit may be amended or revoked at any time by the Board of Health
for violation of the provisions and conditions contained therein or upon such
other reasonable grounds as the Board of Health may deem proper.
C.
No person shall make any false, untruthful or misleading
statement in any application for a permit from the Board of Health. Any false,
untruthful or misleading statement in any application for a permit shall constitute
grounds for the revocation of any permit granted upon application containing
such statement.
A.
It is hereby declared to be the duty of every owner,
lessee, tenant or occupant of any premises within the Town of Ontario to keep
such premises or, if said premises are devoted to a business use, to conduct
the same in such manner that it shall not be a nuisance or dangerous or prejudicial
to life or health.
B.
No person shall violate or refuse or neglect to comply
with any regulation or order of the Board of Health made for carrying into
effect the provisions of this chapter. The violation of or the refusal or
neglect to comply with any such regulation or order which relates to the provisions
of any section of this chapter shall be deemed a violation of such section.
The Health Officer of the Town of Ontario may, at any time, inspect
any premises in the Town of Ontario to determine whether there is compliance
with the provisions of this chapter. No person shall interfere with or obstruct
the Health Officer or other duly authorized representatives of the Board of
Health when making the examination or inspections required by the Board of
Health or when executing its orders.
A violation of any of the provisions of this chapter is an offense punishable
by a fine not to exceed $100 or 25 days' imprisonment, or both, for the
first offense; $250 or six months' imprisonment, or both, for the second
offense; $500 or one year's imprisonment, or both, for a third or subsequent
offense.
A.
No person shall bring into the Town of Ontario, garbage,
offal, refuse or other organic or inorganic waste products without first obtaining
a permit from the Board of Health.
B.
No person shall engage in the business of collecting
garbage, offal, ashes, refuse, rubbish or noisome substances within the Town
of Ontario without first obtaining a permit from the Board of Health.
C.
Every permit granted by the Board of Health pursuant
to this section shall contain the following limitations and may be subject
to other reasonable conditions imposed by the Board of Health:
(1)
Every vehicle used for transporting or collecting of
offal, garbage, ashes or noisome substances shall be suitably covered and
equipped so that no part of the load shall blow, leak or spill.
(2)
If such waste materials are carried in receptacles in
a conveyance, such receptacles shall be suitably covered to prevent leaking,
spilling or blowing of the contents.
Every owner, lessee or occupant of any building, premises or place of
business within the Town of Ontario shall provide or cause to be provided
and, at all times, keep suitable and sufficient receptacles for receiving
and holding offal, garbage, ashes, refuse, rubbish or noisome substances that
may accumulate or be used upon said premises. No such receptacles shall be
kept near any public place longer than may be necessary for the removal of
the contents thereof. All receptacles used for the reception of garbage and
noisome substances shall be provided with proper covers, and such receptacles
shall at all times be securely closed.
No person shall allow accumulations of garbage, offal and noisome substances
upon premises owned or occupied by him or her. When such materials are used
for feeding purposes, only as much shall be fed at any one feeding as shall
be necessary. A residue remaining from a feeding because of overfeeding or
because such materials are fed to animals upon unsanitary feeding grounds
constitute an accumulation under the terms of this section.
A.
No person shall dump or deposit and no place shall be
used for the dumping or depositing of offal, garbage, ashes, papers, refuse,
rubbish or noisome substances within the Town of Ontario, unless a permit
therefor is first obtained from the Board of Health. Each applicant for a
dumping permit shall state the character of the materials to be dumped.
B.
The Board of Health may, at any time, require compliance
with such reasonable conditions as may be applicable to each situation in
order that the dumping ground for which a dumping ground permit is issued
shall not be injurious to public health nor obnoxious or offensive to persons
or property in the vicinity of the place where it is proposed the dumping
shall be done.
It shall be unlawful for any person to construct or maintain private
sewers, septic tanks, cesspools and drains from such sewers, septic tanks
or cesspools in such a manner as to permit the same to discharge the effluent
from such sewers, septic tanks or cesspools into any creek, open ditch or
watercourse or any area directly exposed to the atmosphere, and any and all
such private sewers, septic tanks or cesspools constructed or maintained inside
the Town limits of the Town of Ontario shall be so constructed
that the effluent therefrom shall be discharged into the ground in such a
manner as to permit it to be absorbed by the ground.
No occupation or business that is dangerous or detrimental to life or
health shall be established or carried on in the Town of Ontario.
The business of bone crushing, bone boiling, bone grinding, horse skinning,
cow skinning, glue making from any parts of dead animals, gut cleaning, hide
curing or tanning, fat rendering, boiling of swill or offal, heating, drying
or storing of blood, scrap fat, grease or other offensive animal matter or
offensive vegetable matter or manufacturing materials for manure or fertilizer
shall not be carried on in the Town of Ontario without a permit therefor issued
by the Board of Health or otherwise than in accordance with the terms of said
permit and with the regulations of said Board of Health.
No establishment or place for carrying on the business of slaughtering
cattle, horses, sheep, goats, pigs, calves, swine and poultry shall be conducted
in the Town of Ontario without a permit therefor issued by the Board of Health
or otherwise than in accordance with the terms of said permit and with the
regulations of said Board, and no noisome trade or business shall be opened,
started, established or maintained in the Town of Ontario without a permit
therefor issued by the Board of Health or otherwise than in accordance with
the terms of said permit and with the regulations of said Board.
No person, firm, association or corporation holding a Board of Health
permit for the sale of milk, cream or milk products within the Town of Ontario
shall sell or exchange, offer or expose for sale or exchange, give away or
deliver milk, cream or milk products within the Town of Ontario, except Grade
A pasteurized or certified. The standard for these grades shall be in accordance
with the rules and regulations prescribed by the New York State Department
of Health.
