A. 
The Town desires to furnish an adequate supply of pure and wholesome water to the residences, business and industrial establishments and other water users in the Town, and also to supply sufficient water with sufficient pressure in its water supply system to adequately protect the buildings in the Town from damage or destruction by fire.
B. 
This chapter is therefore enacted in order that the water supply system shall be properly maintained, improved and extended.
This chapter shall apply to all property and water users within the Town. This chapter shall also apply to all users located outside of the Town as terms of a contract by which water is to be supplied to such outside users.
The rules and regulations set forth in this chapter shall be considered a part of the contract of any person who obtains water from the Town, and every such person shall be considered as having expressed his or her consent to be bound by those rules and regulations.
As used in this chapter, the following terms shall have the meanings indicated:
AIR-GAP SEPARATION
A physical break between a supply pipe and a receiving vessel. The air gap shall be at least double the diameter of the supply pipe, measured vertically above the top rim of the vessel, and in no case less than one inch.
APPROVED CHECK VALVE
A check valve that seats readily and completely. It must be carefully machined to have free-moving parts and assured watertightness. The face of the closure element and valve seat must be bronze, composition or other noncorrodible material which will seat tightly under all prevailing conditions of field use. Pins and bushings shall be of bronze or other noncorrodible, nonsticking material, machined for easy, dependable operation. The closure element, e.g., clapper, shall be internally weighted or otherwise internally equipped to promote rapid and positive closure in all sizes where this feature is obtainable.
APPROVED DOUBLE-CHECK VALVE ASSEMBLY
An assembly of at least two independently acting check valves, including tightly closing shutoff valves on each side of the check valve assembly and suitable leak-detector drains, plus connections available for testing the watertightness of each check valve. This device must be approved as a complete assembly.
APPROVED REDUCED-PRESSURE PRINCIPAL BACKFLOW PREVENTION DEVICE
A device incorporating two or more check valves and an automatically operating differential relief valve located between the two checks, two shutoff valves and equipped with necessary appurtenances for testing. The device shall operate to maintain the pressure in the zone between the two check valves less than the pressure on the public water supply side of the device. At cessation of normal flow, the pressure between check valves shall be less than the supply pressure. In case of leakage of either check valve, the differential relief valve shall operate to maintain this reduced pressure by discharging to the atmosphere. When the inlet pressure is two pounds per square inch or less, the relief valve shall open to the atmosphere, thereby providing an air gap in the device. To be approved, these devices must be readily accessible for maintenance and testing and installed in a location where no part of the valve will be submerged. The enclosure must be self-draining so that the large amount of water which the relief valve may vent will be disposed of reliably without submergence of the relief valve. This device must also be approved as a complete assembly.
APPROVED WATER SUPPLY
Any water supply approved by the New York State Department of Health.
AUXILIARY SUPPLY
Any water supply on or available to the premises other than the approved public water supply.
BAROMETRIC LOOP
A loop of pipe rising approximately 35 feet, at its topmost point, above the highest fixture it supplies.
CERTIFIED BACKFLOW PREVENTION DEVICE TESTER
A person who is examined annually by the Water Utilities Department and found competent for the testing of backflow prevention devices. He or she shall be provided with an appropriate identification card which must be renewed annually. Failure to perform his duties competently and conscientiously will result in prompt withdrawal of his or her certification.
CROSS-CONNECTION
Any unprotected connection between any part of a water system used or intended to supply water for drinking purposes and any source or system containing water or substance that is not or cannot be approved as equally safe, wholesome and potable for human consumption.
VACUUM BREAKER, NONPRESSURE TYPE
A vacuum breaker which is designed so as not to be subjected to static line pressure.

A vacuum breaker designed to operate under conditions of static line pressure.
WATER SUPERINTENDENT
The Town of Ontario Superintendent of Water Utilities, who shall direct the Water Utilities Department, subject to the directions of the Town Board.
WATER SUPERVISOR
The consumer or a person on the premises charged with the responsibility of complete knowledge and understanding of the water supply piping within the premises and for maintaining the consumer's water system free from cross-connections and other sanitary defects, as required by regulations and laws.
WATER UTILITIES DEPARTMENT
The Town of Ontario Water Utilities Department, which shall operate the water services provided by the Town, under the direction of the Water Superintendent.

Except for persons who already have water service from the Town at the date of the enactment of this section, every person desiring a supply of water through the Town water mains must make application at the office of the Water Utilities Department for a service pipe and connection with the Town's mains. Such application shall be made in writing upon blank forms furnished by the Town and must be signed by the owner of the property or his or her duly authorized agent.

A. 
Responsibility. All service connections with the Town mains and service pipes from Town mains to approximately the property line, including the stop or curb cock or valve and box for the same, shall be installed by and at the expense of the owner, using licensed and insured site or mechanical contractors, with all work to be inspected by authorized staff of the Town’s Water Utility Department. Such owner shall indemnify and save harmless the Town from all loss or damage that may be occasioned, directly or indirectly, as a result of the such service connection.
B. 
Connection fees. There shall be a service connection fee and an inspection fee that shall apply to all residential, commercial and industrial connections to the public water system within the water benefit area and any extensions thereof completed after the date of the adoption of this chapter. Said fees shall be as set forth in the Town’s Fee Schedule. The owner of the improved property shall be required to pay all such fees to the Town at the time of application for water service.
C. 
Required depth. The owner receiving a permit for the introduction of a water service into his or her premises will be required to cause such service to be placed not less than 60 inches below the surface of the earth at any place between the water main and the street and the inside of the foundation wall of the building into which the water service is introduced.
D. 
Connection of service pipes to water main. All service pipes from the water main must be connected with the main by a separate pipe of not less than 3/4 inch in diameter.
E. 
Service pipes to be of approved material; exception. All service pipes must be of Type K copper material or equivalent, except service pipes of a diameter of four inches or larger may be of ductile or cast-iron pipe.
No person shall make any connection with the curb cock or valve, or extend the same to the meter, located either at the curb or within the cellar, except an employee of the Water Utilities Department, a plumber or a person having a special permit from the Water Utilities Department.
A. 
Owner's responsibility. The owner of property into which water has been introduced by a service pipe shall be required to install and maintain, in good order, at his or her own expense, the service pipe from the principal main to the meter on or for his or her premises, including all fixtures provided for delivering or supplying water for any purpose.
B. 
Authority of Water Utilities Department. In case such service and fixtures are not kept in repair, the Water Utilities Department may make all necessary repairs, and renewals. The expense of such work, and all materials and labor required, shall be paid to the Town by the owner.
The plumber designated and employed by the owner of the premises shall be considered the agent of such owner while employed in the prosecution of the work of introducing water into the premises and not as the agent of the Water Utilities Department. The Town shall not be responsible for the acts of such plumber.
No person except a duly authorized employee of the Water Utilities Department shall open, close or in any way interfere with any valve or gate in any water main, conduit or street pipe.
Any person who has disturbed or displaced a valve box so that the valve stem cannot be reached by a key, or who has covered a valve box or manhole cover of a valve chamber with dirt, paving, plank or other material, shall immediately remove the obstruction or, if necessary, pay the Town for the cost of replacing the valve box.
Officers or employees of the Water Utilities Department, upon presentation of proper credentials, may enter upon any premises where Town water is being supplied, or upon any premises when application is made for a permit to connect plumbing with the Town water main, for the purpose of installing, reading, removing, upgrading, changing or repairing meters, or for inspecting the plumbing and fixtures of the water service, or for other work in connection with such service. By accepting water service from the Town, a property owner or resident has consented to such entry.
A. 
Generally. The Water Utilities Department shall have the right to limit the amount of water furnished to any property should circumstances deem to warrant such action, although no limit may be stated in the application or permit for use. Furthermore, the Water Utilities Department may entirely shut off the water supply used for any manufacturing purpose, or for furnishing power, or for lawn sprinkling, at any time, by giving reasonable notice to the property owner of such intended action.
B. 
Repairs; new work. Whenever the Water Utilities Department is constructing or installing new water mains or equipment, making repairs, or conducting leakage tests, the Town reserves the right to shut off the water from any consumer, without notice, for as long a period as may be necessary.
Neither the Water Utilities Department nor the Town shall be liable for any damage of any kind which may result to any person or premises from shutting off the water from any main or service, for any purpose whatever, even in cases where no notice is given, or for any change, either increase or decrease, in pressure of water supplied from any cause whatever.
No person shall open any fire hydrant or draw water from any fire hydrant except under the direction of the Water Utilities Department or the Fire Department.
