By the adoption of this chapter, the Town Board of the Town of Schodack
declares its intent to regulate, in a manner consistent with the interests
of the citizens of the Town of Schodack, the use of water during the imposition
of water use restrictions imposed by the town and/or the Village of Castleton.
These restrictions, imposed during periods of water shortage, are a public
health necessity. Therefore, recognizing the above and the need for adequate
regulation and enforcement of these restrictions and in the exercise of its
police powers in this regard, the Town Board of the Town of Schodack does
hereby enact this chapter.
The Town Board of the Town of Schodack declares its intent to allow
the Town Supervisor to impose total or partial water restrictions on a per-district
basis whenever he declares a public emergency or whenever one is declared
by the Mayor of the Village of Castleton for residents outside the village
serviced by the village of Castleton. When imposed, water use restrictions
shall remain in effect until further notice by the town.
The enforcement of this chapter shall be performed by any of the following:
Town Building Inspector, town police, Town Highway Superintendent or their
designees.
