A.Â
The term "bituminous concrete plant" (commonly referred
to as "asphalt plant") as used in this section shall mean an industrial facility
which produces bituminous concrete. The production of bituminous concrete
is defined as the process of mixing asphalt liquid with sand and aggregate.
This definition does not include any facility which engages in the production
of liquid asphalt.
B.Â
The, following changes to the physical, and/or operational
characteristics of any bituminous concrete plant located within the village
shall be exempt from environmental quality review pursuant to this chapter
and shall be a Type II action which is exempt from environmental review under
§ 617.5 of the SEQRA regulations:
(1)Â
The relocation of the bituminous concrete plant within
the plant envelope area.
(2)Â
Changes or expansions in the operation, physical size
and/or capacity of the bituminous concrete plant which would:
(a)Â
Increase peak hourly and average daily truck traffic
volumes by 10% or less (assuming trucks of equal tonnage);
(b)Â
Increase noise levels at the property line in any given
hour (L eq[1]) by 10% or less;
(c)Â
Increase the shipping and processing capacity of the
bituminous concrete plant by 10% or less;
(d)Â
Increase of vibration by 10% or less;
(e)Â
Increase of lighting extending beyond the plant envelope
area by 10% or less; and
(f)Â
Not result in the violation of county, state or federal
air pollution standards.
