Village of Tarrytown, NY Chapter 237 Recycling

§ 237-1 Legislative intent; purpose.

The Board of Trustees of the Village of Tarrytown believes that the recycling of newspapers, cardboard boxes, glass, metal containers and plastic containers (PETE and HDPE) will prevent wasteful incineration, lower the Village's charges for refuse disposal, provide an additional revenue stream to the Village and will help to conserve natural resources. Mandatory recycling of newspapers, cardboard boxes, glass, metal containers and plastic containers (1-PETE; 2-HDPE; 3-V; 4-LDPE; 5-PP; 6-PS; and 7-OTHER) will remove a significant tonnage of material from the solid waste stream and divert it to a recyclable use. It is the purpose of this chapter to institute a program of mandatory recycling for specific recyclable materials in an attempt to derive maximum environmental and economic benefit with minimum inconvenience to residents and property owners.

§ 237-2 Preparation of materials for collection.

A. The owners, lessees or occupants of all structures within the Village who receive refuse collection services from the Village of Tarrytown shall package newspapers, cardboard boxes, food and beverage containers made of glass, metals (tin, aluminum and other metals) and plastic No. 1 through plastic No. 7 for collection and recycling by the Department of Public Works or its duly authorized agent.

B. Newspapers shall be placed in plain brown paper bags, corrugated cardboard box or nondisposable covered containers. In no case shall the bag, box or container exceed 50 pounds in weight. Newspapers may be commingled in the same bag, box or container with cardboard. Paper in plastic bags cannot be accepted. Only newsprint or computer paper can be accepted; no other type of paper should be included in the package, bag or container.

C. Cardboard boxes shall be cut into pieces, maximum size four feet by four feet. The cardboard shall be placed in plain brown paper bags, corrugated cardboard box or nondisposable covered containers. In no case shall the bag, box or container exceed 50 pounds in weight. Cardboard may be commingled in the same bag, box or container with newspapers. Cardboard in plastic bags cannot be accepted.

D. Glass containers shall be cleaned on both the inside and the outside of the container. Metal caps, tops or lids and the metal ring at the top of the glass container must be removed. Plastic caps and the plastic ring at the top of the glass container shall be placed in the recycling container. Glass containers shall be placed in blue boxes or other nondisposable containers, not exceeding 50 pounds in weight per bag, box or container. Glass containers may be commingled with plastic containers and metal containers.

E. Plastic containers No. 1 through 7 shall be cleaned on both the inside and the outside of the container. Metal caps, tops or lids and the metal ring at the top of the plastic container must be removed. Plastic caps and the plastic ring at the top of the glass container shall be placed in the recycling container. Plastic containers shall be placed in blue boxes or other nondisposable containers, not exceeding 50 pounds in weight per container. Plastic containers may be commingled with glass containers and metal containers.

F. Metal containers made of tin, aluminum and other metals shall be cleaned on both the inside and the outside of the container. Metal containers shall be placed in blue boxes or other nondisposable containers not exceeding 50 pounds in weight per container. Metal containers may be commingled with glass containers and plastics.

G. Recyclables as prepared for collection as noted in Subsections B, C, D, E and F shall be placed at curbside for collection, or other authorized location. Recyclables shall not be placed at the curbside prior to 8:00 p.m. on the day before the day of collection.

H. Failure to separate recyclables and to place such recyclables at curbside for collection and recycling shall be considered a violation of this chapter.

§ 237-3 Curbside placement to become Village property; exceptions.

A. With the exception of recyclables placed at curbside in connection with volunteer or charitable recycling drives, from the time of placement of recyclables at the curb for collection by the Village of Tarrytown or its authorized agent, pursuant to the rules and regulations herein contained or hereafter promulgated, such recyclables shall become the sole property of the Village of Tarrytown or its authorized agent. The Village shall provide notice to the public regarding any volunteer or charitable recycling drives.

B. It shall be a violation of this chapter for any persons unauthorized by the Village of Tarrytown to pick up or cause to be collected or picked up any such recyclables.

§ 237-4 Penalties for offenses.

A. Any person, whether that person is owner, lessee or occupant, who violates any provision of this chapter or the rules and regulations established pursuant thereto shall, upon conviction thereof, be subject to a fine of not less than $50 nor more than $250.

B. Failure to comply with the terms of this chapter on subsequent recycling collection days shall be considered a separate offense.
