A. 
The following are hereby established as the metered parking lots operated by the Borough of Carlisle:
(1) 
West Pomfret Street Lot, located between South Hanover Street and South Pitt Street.
(2) 
West Louther Street Lots.
(a) 
Located on the north side of the street between North Hanover Street and North Pitt Street.
(b) 
Located on the south side of the street between North Hanover Street and North Pitt Street.
(3) 
East Louther Street Lots.
(a) 
Located on the north side of the street between North Hanover Street and North Bedford Street.
(b) 
Located on the south side of the street between North Hanover Street and North Bedford Street.
(4) 
West Locust Avenue Lot, located on the north side of the avenue between North Hanover Street and North Pitt Street.
(5) 
Liberty Avenue Lot, located on the southeast intersection of Liberty Avenue with Poplar Avenue.

B. 
The Pomfret Street Parking Garage is hereby established as a fee parking facility operated by the Borough of Carlisle.

A. 
The parking meters on said off-street parking lots shall be in operation from 8:00 a.m. to 4:00 p.m., Monday through Saturday, and shall not be in operation on Sundays, legal holidays and any other time period which the Borough Council by resolution has designated to be a time when metered parking shall not be in operation on said off-street parking lots.
B. 
When said meters shall be in operation, the parking time limit for each space shall be as designated on the meter immediately adjacent to the individual parking space, and it shall be unlawful for any person to park a vehicle or allow the same to remain parked for longer than 10 hours where the meter immediately adjacent to the individual parking space is designated as a ten-hour (i.e., long-term) meter, for longer than two hours where the meter immediately adjacent to the individual parking space is designated as a two-hour (i.e., short-term) meter or for longer than 1/2 hour where the meter adjacent to the individual parking space is designated as a one-half-hour (i.e., limited-term) meter between the hours that metered parking shall be in effect. The rate for long-term meters shall be $0.25 per hour, with two-hour minimum increments. The rates for short-term meters shall be, when paid by credit card, $1.15, with a one-hour minimum transaction required, and when paid by coin, $0.05 for four minutes, $0.10 for eight minutes, $0.15 for 12 minutes, $0.35 for 28 minutes and $0.75 for one hour. The rate for limited-term meters shall be $0.25 per 1/2 hour with six-minute increments at $0.05 each and twelve-minute increments at $0.10 each. Short-term and long-term meters on all lots shall contain a device permitting a user to access the initial fifteen-minute period without charge, excepting, however, short-term and long-term meters governing designated handicap parking spaces shall have a device permitting a user to access the initial thirty-minute period without charge. Limited-term meters shall allow no free parking.

C. 
No vehicle shall be parked in the Pomfret Street Parking Garage for a period in excess of 24 hours, excepting solely the vehicles of hotel guests and vehicles of monthly permit holders.

A. 
Parking shall be prohibited in the metered parking lots operated by the Borough of Carlisle on the days and times as follows:
(1) 
West Pomfret Street Lot, located between South Hanover Street and South Pitt Street, on Mondays, from 12:00 midnight to 6:00 a.m.
(2) 
West Louther Street Lots.

(a) 
Located on the north side of the between North Hanover Street and North Pitt Street, on Tuesdays, from 12:00 midnight to 6:00 a.m.
(b) 
Located on the south side of the street between North Hanover Street and North Pitt Street, on Wednesdays, from 12:00 midnight to 6:00 a.m.
(3) 
East Louther Street Lots.
(a) 
Located on the north side of the street between North Hanover Street and North Bedford Street, on Thursdays, from 12:00 midnight to 6:00 a.m.
(b) 
Located on the south side of the street between North Hanover Street and North Bedford Street, on Fridays, from 12:00 midnight to 6:00 a. m.
(4) 
West Locust Avenue Lot, located on the north side of the avenue between North Hanover Street and North Pitt Street, on Fridays, from 12:00 midnight to 6:00 a.m.
(5) 
Liberty Avenue Lot, located on the southeast intersection of Liberty Avenue with Poplar Avenue, on Tuesdays from 3:30 a.m. to 5:30 a.m.

B. 
Parking may be prohibited in any metered parking lot and in the Pomfret Street Parking Garage for a limited time period at the direction of the Manager of the Borough of Carlisle for municipal purposes; provided, however, that adequate notice thereof is posted in the affected facility prior to the time when parking is to be prohibited.

C. 
Exemption for jurors. Notwithstanding any other provision of this Article VI, it shall not be unlawful for a person during a time of actual jury duty with the Court of Common Pleas of Cumberland County, Pennsylvania, to permit his or her vehicle to remain in a parking space adjacent to a meter in a metered parking lot operated by the Borough of Carlisle without payment of parking meter charges, provided that:
(1) 
The Borough shall have arranged for compensation for such dispensation to be received from the County of Cumberland;
(2) 
A permit or similar indication authorized by the Borough shall be prominently displayed upon the vehicle, evidencing the juror's status; and
(3) 
Such parking shall be otherwise permitted.
Parking meters installed in the said lots shall be placed immediately adjacent to the individual parking spaces that shall be marked off in the said lots. Each parking meter shall be placed or set in such manner as to show if the parking space adjacent to such meter is or is not legally occupied. Each parking meter installed shall indicate by proper a legend the legal time established by this article and, when occupied, shall indicate on and by its dial and pointer the duration of the period of legal parking and, on the expiration of such period, shall indicate illegal or overtime parking.

It shall be unlawful to park any vehicle in any of the said parking lots otherwise than with the foremost part of the parked vehicle nearest to the parking meter applicable thereto, or to park any vehicle in any of the parking spaces in said Pomfret Street Parking Garage otherwise than with the foremost part of the parked vehicle nearest the wall.
Whenever a vehicle is to be parked in any of the said parking lots at any time during which the parking meters therein shall be in operation, the driver of such vehicle shall, upon entering a parking space adjacent to a parking meter, immediately deposit or cause to be deposited in such parking meter one or more coins of the United States as shall be specified in the legend upon such parking meter. Upon the deposit of such coin or coins and placing the meter in operation, such parking space may be lawfully occupied by such vehicle for the length of time designated by § 244-49 of this article for parking in the said parking lot upon deposit of such coin or coins. If any vehicle shall remain in any such parking space for such length of time that the meter shall indicate by a proper signal that the lawful parking time shall have expired, such vehicle shall be considered as having been parked overtime, and the parking of a vehicle overtime shall be a violation of this article. Every hour that a vehicle shall remain parked at a meter showing a violation shall constitute a separate violation of this article.

Notwithstanding any applicable state law relieving a driver of a vehicle being operated by or for the transportation of a handicapped person or severely disabled veteran of liability for parking for a certain time in excess of the legal parking period under certain circumstances, the deposit of proper coins or payment of proper rental shall be required for such use. It shall be unlawful and a violation of this article for any person to permit a vehicle to remain parked in an off-street fee parking facility without depositing one or more proper coins of the United States as shall be specified in the legend upon such parking meter when the meter indicates by signal that the deposit of such coins is required to continue lawful occupation of such metered space, or for any person to permit a vehicle to remain parked in the Pomfret Street Parking Garage without payment of proper rental.
It shall be unlawful and a violation of this article for any person to deface, tamper with, open or willfully break, destroy or impair the usefulness of any parking meter installed under the provisions of this article. Nothing herein shall apply to the servicing or opening of parking meters by officers, employees and/or police officers of the Borough under the direction of the Mayor and/or the Borough Council.

The metered parking lots hereby established and the Pomfret Street Parking Garage are hereby declared to for the use of private passenger vehicles only, and it shall be unlawful and a violation of this article for any person to park in such lots or garage any bus, truck, tractor, trailer, tractor-trailer or commercial vehicle of any kind or nature. The use of unicycles, bicycles, roller skates, roller blades, skateboards, scooters, wagons, sleds and other self-propelled means of transportation is hereby prohibited in or upon any fee parking facility. Notwithstanding the foregoing, the use of self-propelled or mechanically propelled devices necessary for the transportation of handicapped persons is not prohibited in or upon such facilities. No person operating a vehicle having a height in excess of seven feet, measured from ground level, shall attempt to enter the Pomfret Street Parking Garage.
A. 
It shall be the duty of the police officers of the Borough, acting in accordance with instructions of the Chief of Police, to report:
(1) 
The name of the parking lot and the number of the parking meter therein that indicates that the vehicle occupying the parking space adjacent thereto is or has been parked in violation of any of the provisions of this article.
(2) 
The date and hour of such violation.
(3) 
The state license number of such vehicle.
(4) 
Any other facts, the knowledge of which shall be necessary for a thorough understanding of the circumstances attending such violation.
B. 
Every police officer shall also place upon such vehicle a notice that such vehicle was parked in violation of this article, which notice shall contain instructions to the owner or driver of such vehicle that, if he or she shall pay, for the use of the Borough, the sum of $15 within 10 days after the time of such notice, or the sum of $20 if paid after 10 days, the same shall save the violator from prosecution and from the additional payment of the costs of prosecution. Payment shall be made by United States Mail to the office of the Finance Director, in person at the Borough Hall, at the drop box at either the Borough Hall or the Police Department or by online Internet payment. The owner or driver shall be liable for the necessary postage if he or she mails such amount; provided, however, that for each additional notice of violation by the same vehicle within the same parking space in the same twenty-four-hour period, the required payment within 10 days after the time of such notice shall be the sum of $10 to save such violator from prosecution.

C. 
For purposes of this section and article, meter attendants employed by the Borough for the purpose of policing the use of parking meters are authorized to enforce the parking laws and are included within the definition of “police officer.”
D. 
Parking garage violations.

(1) 
It shall be the duty of the police officers of the Borough, acting in accordance with instructions of the Chief of Police, to report:
(a) 
The name of the Pomfret Street Parking Garage and the number of the parking space or location of the vehicle that indicates that such vehicle has been parked in violation of any of the provisions of this article.
(b) 
The date and hour of such violation.
(c) 
The state license number of such vehicle.
(d) 
Any other facts, the knowledge of which shall be necessary for a thorough understanding of the circumstances attending such violation
(2) 
Every such police officer shall also place upon such vehicle a notice to the owner or driver thereof that such vehicle was parked in violation of such provisions of this article. For purposes of this section and article, meter attendants employed by the Borough for the purpose of policing the use of parking spaces are authorized to enforce the parking laws and are included within the definition of "police officer."

A. 
The Borough of Carlisle is hereby authorized to lease parking spaces in Borough-owned lots and the Pomfret Street Parking Garage to citizens on a monthly basis.
B. 
The Borough Council may, at its option, lease individual parking spaces in Borough lots and the Pomfret Street Parking Garage for fixed periods of time at a rental fee per month as set forth in Chapter 120, Fees, as enacted and ordained and as may be, from time to time, amended.

A. 
Borough-owned lots.
(1) 
Upon payment of the monthly rental fee provided for in § 244-59 of this article, the Borough of Carlisle shall issue a permit allowing parking in the leased space.
(2) 
The permit shall be valid for each month for which the monthly rental fee has been fully paid; full payment shall include payment of any rental fee increase imposed subsequent to prepayment, in accordance with § 120-43 of Chapter 120.
(3) 
The permit shall contain the name and address of the lessee of the space, the expiration date of the permit and the identification number of the leased space.
(4) 
The permit issued shall constitute authorization for parking only in the space identified by said identification number.
(5) 
The permit shall be displayed by the lessee of the space on the dashboard on the driver’s side of his or her vehicle so that it is not obstructed from view.
B. 
Pomfret Street Parking Garage.
(1) 
Upon payment of the monthly rental fee provided for in § 244-59 of this article, the Borough of Carlisle shall issue a permit allowing parking in the leased space.
(2) 
The permit shall be valid for each month for which the monthly rental fee has been fully paid; full payment shall include payment of any rental fee increase imposed subsequent to prepayment, in accordance with § 120-43 of Chapter 120.
(3) 
The Borough Council shall determine, from time to time, the number of designated leased parking space permits (designated by reserved space number) and the number of undesignated entry passes. (See Chapter 120, Fees, § 120-20H.)
(4) 
It shall be unlawful for anyone other than the holder of a designated space permit to park in the numbered space for which the permit was issued. It shall be unlawful for any holder of a designated leased parking space to park in any other space without paying the appropriate daily fee.

It shall be unlawful and a violation of this article for any person to park any vehicle or allow the same to remain parked in a parking space leased by the Borough of Carlisle without the display of a valid parking permit as provided for in § 244-60 of this article. Display of a valid parking permit shall not be required in the Pomfret Street Parking Garage.

It shall be unlawful for any person to congregate with another or others in a parking lot or the Pomfret Street Parking Garage operated by the Borough of Carlisle, between sundown and sunup,[1] for a period of more than 10 minutes or for a period longer than necessary to complete the parking and renewal of his or her vehicle and the traversing of the lot or garage in leaving or returning to the vehicle, whichever period is greater, provided, however, that no prohibition under this section shall be effective unless a sign is posted on such lot or garage indicating that congregating is prohibited during such times, and provided that no proscription under this section shall apply to activities for the repair and maintenance of such lots or garage or to activities on such lots or garage for the protection or promotion of health, safety or the general welfare. Each violation of this section shall be punishable by a fine of not less than $5 nor more than $25, plus costs or prosecution assessable to the violator. In default of payment of such fine or costs, where the default is not caused by indigency, the violator may be sentenced to undergo imprisonment for not more than five days.

Any person violating any provision of this article with respect to any Borough parking lot, except for §§ 244-56 and 244-62 thereof, shall, for each and every such violation, upon conviction thereof, be sentenced to pay a fine as set forth in § 244-81 and, in default of payment of such fine and costs, to undergo imprisonment for not more than five days. Any person violating any provision of this article concerning the Pomfret Street Parking Garage or who shall violate any provision of § 244-56 of this article shall, for each and every such violation, upon conviction thereof be sentenced to pay a fine of not more than $50 and costs of prosecution and, in default of payment of such fine and costs, to undergo imprisonment for not more than 10 days.

It shall be unlawful for any person not having business with or on behalf of Carlisle Borough to park any vehicle or to allow the same to remain parked on the parking lot behind the Carlisle Municipal Building, 53 West South Street, Carlisle, Pennsylvania,[1] provided, however, that this prohibition shall not be effective in the absence of one or more signs posted on said lot indicating such prohibition.[2]
