The intent of the OR Office Residential District
is to:
A. Recognize an area of existing single-family houses
which may have declined in suitability as residences because of immediate
proximity to arterial streets experiencing increases in traffic and
to industrial uses.
B. Provide an option to these landowners to continue
to maintain a residence or to convert to a limited commercial use.
C. Make sure that any commercial use would not be so
intense as to create nuisances to neighboring residences or additional
traffic hazards.
In the OR District, land, buildings or premises
shall be used by right for one of the following uses but for no others:
A. Any use listed as permitted by right or by accessory
use in the R-1 District, within the requirements of the R-1, and not
the OR, District.
The following uses are permitted as special
exception uses when authorized by the Zoning Hearing Board:
A. Office, which may include one dwelling unit within
the same building on the lot.
B. One retail sales or personal service establishment
on a lot, not including motor vehicles sales, adult bookstore, adult
movie theater or massage parlor.
The Zoning Hearing Board shall only permit a
special exception use if it determines that the use would be compatible
with any adjacent dwellings, especially concerning glare, litter,
noise, intensity, hours of operation, character of use and numbers
of employees.
The Zoning Hearing Board shall only permit the
use where it determines that the number of driveways onto an arterial
street would be held to an absolute minimum.
The only business sign that shall be permitted
for a special exception use shall be one on-premises sign that is
not illuminated, that has a maximum sign area of six square feet and
that has a maximum height of six feet, except that an auto service
station may have a maximum sign area of 16 square feet on each of
two sides.
Any off-street parking area intended for three or more vehicles shall be separated from the lot line of any abutting dwelling by a fifteen-foot-wide buffer yard with screening as required by §
255-191, except this buffer yard shall be 30 feet from an auto service station.
All paved areas shall be set back a minimum
of 20 feet from the street line.
The following regulations shall be observed:
A. Lot area: 6,000 square feet minimum, except that 12,000
square feet minimum shall be required for a retail sales use.
B. Front yard setback line: 40 feet minimum for both
principal and accessory structures.
C. Lot width: 60 feet minimum at the street line, except
no lot shall be subdivided in such a way as to create an additional
driveway onto an arterial street, and provided that 120 feet minimum
shall be required for a retail sales use.
D. Coverage: maximum of 30% building coverage and 50%
impervious coverage.
