The Town Council hereby signifies its intention and desire to organize an authority under the provisions of the Municipality Authorities Act of 1945.[1]

A. 
The Burgess, the President of the Town Council and the Secretary are hereby authorized and directed to execute, on behalf of the Borough of Chambersburg, Articles of Incorporation for said Authority, in substantially the following form:
Articles of Incorporation
To the Secretary of the Commonwealth,
Commonwealth of Pennsylvania:
In compliance with the requirements of the Act of May 2, 1945, No. 164, known as the "Municipality Authorities Act of 1945," the Burgess and Town Council of the Borough of Chambersburg, in Franklin County, Pennsylvania, desiring to incorporate an Authority thereunder, does hereby certify:
1.
The name of the Authority is "The Municipal Authority of the Borough of Chambersburg."
2.
Said Authority is formed under the provisions of the Act of May 2, 1945, No. 164.
3.
No other Authority organized under the Act of May 2, 1945, No. 164, or under the Act of June 28, 1935, P.L. 463, as amended, or under the Act of December 27, 1933 (Special Session, 1933, P.L. 114), is in existence in or for the incorporating municipality, the Burgess and Town Council of the Borough of Chambersburg.
4.
The name of the incorporating municipality is the Burgess and Town Council of the Borough of Chambersburg, in Franklin County, Pennsylvania.
5.
The names and addresses of its municipal authorities are as follows:_

The names, addresses and terms of office of the first members of the Board of the Municipal Authority to be formed hereby are as follows:_
7.
The ordinance authorizing the creation of said Authority, certified from the records of the Burgess and the Town Council of the Borough of Chambersburg, together with advertisement of notice of filing these Articles of Incorporation, are each submitted herewith.
The term of existence of said Authority shall be 50 years from the day of approval of these Articles of Amendment to the Articles of Incorporation.

B. 
The Town Council of the Borough of Chambersburg authorizes and approves the following amendment to the Municipal Authority of the Borough of Chambersburg's Articles of Incorporation:

(1) 
The Articles of Incorporation shall be amended to provide as follows: The projects which shall be undertaken by said Authority are to acquire, hold, construct, improve, maintain, operate, own, lease, either as lessor or as lessee, water and sewer works, water and sewer supply, water distribution systems and sewer collection systems for the Borough of Chambersburg and for such other territory as it may be authorized to serve. The Authority shall also be authorized to own, operate and maintain stormwater controls and related facilities and engage in stormwater planning, management, and implementation.
(2) 
The Authority's term of existence shall be extended 50 years from the date of approval of the Articles of Amendment.
(3) 
Section 1 of the Articles of Incorporation shall be amended so that the name of the Authority, "The Municipal Authority of the Borough of Chambersburg," is changed to the "Chambersburg Area Municipal Authority."

C. 
The Town Council of the Borough of Chambersburg authorizes and approves the following amendments to the Chambersburg Area Municipal Authority's Articles of Incorporation: [Added 5-9-2016 by Ord. No. 2016-03][2]
(1) 
The Articles of Incorporation shall be amended to provide that in addition to the projects currently permitted to be undertaken by the Authority in the Articles of Incorporation, the Authority shall continue to be permitted to finance the following projects:
(a) 
The Authority shall be permitted to finance projects, to include buildings to be devoted wholly or partially for public uses, including public schools, libraries, and facilities for the conduct of judicial proceedings and for revenue-producing purposes;
(b) 
Hospitals and health centers;
(c) 
Buildings and facilities for private, nonprofit, nonsectarian secondary schools, colleges and universities, state-related universities and community colleges, which are determined by the Authority to be eligible educational institutions, provided that such buildings and facilities shall have been approved by resolution or ordinance adopted by the governing body of the municipality or municipalities organizing the Authority and that the approval does not obligate the taxing power of the governing body in any way; and
(d) 
Industrial development projects, including, but not limited to, projects to retain or develop existing industries and the development of new industries, the development and administration of business improvements and administrative services related thereto.

The project which shall be undertaken by said Authority is to acquire, hold, construct, improve, maintain, operate, own and lease, either as lessor or as lessee, waterworks, water supply works and water distribution systems for the Borough of Chambersburg and for such other territory as it may be authorized to serve.

The Municipal Authority of the Borough of Chambersburg is hereby authorized to acquire, hold, construct, improve, maintain, operate, own and lease, either in the capacity of lessor or lessee, sewers, sewer systems or parts thereof, and sewage treatment works, including works for treating and disposing of industrial waste, for the Borough of Chambersburg and for such other territory as it may be authorized to serve.

The Chambersburg Area Municipal Authority of the Borough of Chambersburg is hereby authorized to acquire, hold, construct, improve, maintain, operate, own and lease, either in the capacity of lessor or lessee, commercial, industrial, or business district real estate, or parts thereof, and parks, parking lots, utility systems, including municipal infrastructure, for the Borough of Chambersburg and for such other territory as it may be authorized to serve, for the benefit of commercial, residential, or industrial redevelopment, expansion of employment, the tax base, or sales of utilities.
