§ 286-7 Motor vehicles not to be driven on sidewalks.

No person shall operate a motor vehicle or tractor upon any sidewalk in the Borough, nor shall any person operate a motor vehicle upon or across any sidewalk except in order to gain access to or egress from a driveway or alley at such locations where the curb, if such sidewalk is curbed, shall have been properly cut down for the purpose. Any person who shall violate any provision of this section shall, upon conviction thereof, be sentenced to pay a fine of not more than $50 and costs of prosecution and, in default of payment of such fine and costs, to undergo imprisonment for not more than 10 days.

§ 286-9 Traffic signals at certain intersections.

Any person who shall operate a motor vehicle or tractor upon any highway or portion thereof hereby established as a one-way highway other than in the direction hereby established for traffic thereon shall, upon conviction thereof, be sentenced to pay a fine of not more than $10 and costs of prosecution and, in default of payment of such fine and costs, to undergo imprisonment for not more than five days, provided that the provisions of this section shall not be applicable to operators of the vehicles of the Fire Department of the Borough of Chambersburg when operating such vehicles in response to an alarm.

§ 286-11 Left and/or right turns or going straight prohibited at certain intersections.

It shall be unlawful for the operator of any vehicle or tractor traveling upon the first-named highway at any of the following intersections, in the direction or directions hereby indicated in each case, to make a left turn and/or a right turn or to travel straight ahead at said intersection, as hereby indicated:

§ 286-12 Traffic to keep to right of certain center structures and barriers.

All vehicular traffic shall keep to the right of the following structures or barriers located in the center of the specified intersections:

The following intersections are hereby established as stop intersections, and official stop signs shall be erected (or are hereby ratified if heretofore erected) in such a position as to face traffic approaching the second-named street upon the first-named street, in the direction or directions hereby indicated. It shall be unlawful for all vehicles approaching any such intersection upon the first-named street, in the direction or directions hereby indicated, to not come to a full stop, within a reasonable distance, before entering any such intersection:

§ 286-15 Yield right-of-way intersections established.

The following intersections are hereby established as yield right-of-way intersections, and official yield signs shall be erected (or are hereby ratified if heretofore erected) in such a position as to face traffic approaching the second-named highway from the first-named highway, in the direction or directions hereby indicated. All vehicles and tractors approaching any such intersection upon the first-named highway, in the direction or directions hereby indicated, shall yield the right-of-way to any vehicle in the intersection or approaching on the second-named highway so closely as to constitute an immediate hazard during the time that the operator of such vehicle or tractor is moving across or within such intersection.

§ 286-16 Vehicle weight limits established.

§ 286-16.1 Vehicle length limits.

It shall be unlawful for any person to operate any class or type of motor vehicle, tractor, trailer or tractor-trailer combination having a total length in excess of that herein respectively prescribed upon any of the following highways or portions thereof, unless expressly exempted:

§ 286-17 Highways closed for construction or repair.

It shall be unlawful for any person to operate any vehicle or tractor upon any highway in the Borough that is under construction, resurfacing or repair, in disregard of any official sign, barricade or notice that the same is closed to vehicular traffic.

§ 286-17.1 Highways closed except for emergency services vehicles.

It shall be unlawful for any person to operate any motor vehicle or tractor upon any highway in the Borough that has been designated as restricted to emergency services vehicles as defined by the provisions of the Pennsylvania Vehicle Code, 75 Pa.C.S.A. § 101 et seq., as amended. Those highway segments as designated:

Penalties for violation of Subsection A.

(1)

Any person and/or entity violating Subsection A of this section shall, upon conviction thereof, be guilty of a summary offense and sentenced to pay a fine of not more than $200, plus court costs and reasonable attorney fees, and in the event of default of payment, such violator may be sentenced to imprisonment for a period not to exceed five days.

(2)

Borough police officers and peace officers as defined herein are hereby duly authorized to issue a ticket in the form established by the Borough to any person and/or entity violating the provisions of Subsection A of this section. The ticket shall instruct such violator that if he, she, or it reports to the Borough office and pays the Borough the sum of $50 within 72 hours of the date of issuance of the ticket, then such payment shall save the violator through prosecution by a citation, which prosecution may result in court costs and attorney fees being assessed against the violator in addition to the fine.

(3)

Notwithstanding the above, any police officer or peace officer shall have the sole and absolute discretion to issue a citation without first issuing a ticket as provided for herein.

§ 286-18 Streets closed for special events or block parties.

The Mayor, or their designee, is hereby authorized to designate as closed those highways within the Borough of Chambersburg whenever they shall deem such action advisable and for whatever period of time directed by him, any portion of any highway except for state highways in the Borough whereon sledding, coasting, other recreational activities, or social events shall be permitted. Such highways shall be set apart for the purpose under the direction of the Mayor or their designee. No persons shall operate any motor vehicle or tractor upon any such highway at any time when such highway shall be so designated, except in case of emergency, with special permission of the Mayor or of the police officer in charge, who shall first clear such play highway of all persons using such highway for the purpose for which it was set aside. Any person who shall violate any provision of this section shall, upon conviction thereof, be guilty of a summary offense and sentenced to pay a fine of not more than $200 plus court costs and reasonable attorney fees, and, in the event of default of payment, such violator may be sentenced to imprisonment for a period not to exceed five days.

§ 286-19 Local traffic only on certain highways.

The following highways or portions of highways are hereby designated as being for local traffic only:

Any person who shall use a through highway or portions thereof hereby designated as being for local traffic only shall, upon conviction thereof, be guilty of a summary offense and sentenced to pay a fine of not more than $25 plus court costs and reasonable attorney fees. In the event that there is a default of payment of such fine and costs, such person may be imprisoned for not more than five days. "Local traffic" as used herein, shall mean access to and egress from properties and business or parking facilities located along said streets.

§ 286-20 No stopping.

The following highways or portions of highways are hereby designated as no stopping areas and no vehicle may stop in such areas:

In accordance with the Pennsylvania Vehicle Code, 75 Pa.C.S.A. § 3353(a)(1)(x), no person shall stop a vehicle in the designated fire lanes in front of the South Gate Mall and the K-Mart Shopping Center in the Borough of Chambersburg.

In accordance with the Pennsylvania Vehicle Code, 75 Pa.C.S.A. § 3353(a)(1)(x), no person shall stop a vehicle in the designated fire lanes in front of the Giant Food Store in the Wayne Avenue Plaza.

§ 286-21 No stopping or standing.
