A. 
Establishment of district. A zoning overlay district, to be known as the Southgate Neighborhood Overlay District, is hereby established.
B. 
Description of district. The bounds of the Southgate Neighborhood Overlay District shall be as described and depicted in Appendix A hereto[1] and the Southgate Neighborhood Overlay District shall be graphically shown on the Chambersburg Zoning Map.

C. 
Purpose of district. The purpose of the Southgate Neighborhood Overlay District is to superimpose unique requirements on the underlying zoning districts to promote economic infill development in an underutilized portion of the community. This district is to serve as a transitional zone between the adjacent Central Core Zone and the underlying Distributed Commercial Highway and Central Core Zones.

Height regulations. Refer to the underlying zoning district.
B. 
Area regulations. Refer to the underlying zoning district.
C. 
Yard regulations. The Central Core yard regulations shall apply.

D. 
Coverage regulations. The Central Core lot coverage regulations shall apply.
A. 
Parking facilities required. The parking requirement shall be half (50%) of the parking facilities required in Article XIII.
B. 
Location of parking spaces. The parking facilities are not required to be located on the same lot as the principal building(s); however they must be located within the Southgate Neighborhood Overlay District.
C. 
Ownership of parking spaces. The parking facilities are not required to be under the same ownership of the principal building(s) as long as such facilities are:
(1) 
Owned by a homeowners association or commercial business association, of which the owner of the principal building(s) is a member; or
(2) 
Owned by the Borough of Chambersburg (Borough) or the Chambersburg Area Municipal Authority (CAMA) and available to serve the parking facilities requirement of the owner of the principal building(s) in accordance with a written agreement with the Borough or CAMA, as applicable.
(3) 
The above parking facilities can be shared parking facilities, provided that in the collective, the number of parking facilities required hereunder are met.
A. 
Attached dwellings. Attached dwellings shall be limited to no more than 12 dwelling units to a building.
Any land development plan submitted to the Borough of Chambersburg in accordance with Chapter 258, Subdivision and Land Development, that includes property within the Southgate Neighborhood Overlay District shall also be submitted to the Southgate Neighborhood Advisory Committee for review. The Southgate Neighborhood Advisory Committee shall consist of not more than seven members appointed to serve at the pleasure of Town Council, which members may be citizens or stakeholders from the Southgate neighborhood. The review of the Southgate Neighborhood Advisory Committee shall be advisory only and shall be submitted to Town Council prior to Town Council's final action on such a plan. Members of the Southgate Neighborhood Advisory Committee shall not be compensated. Borough Land Use and Community Development staff will assist in coordinating Southgate Neighborhood Advisory Committee meetings at Borough Hall.
Where there exists a conflict between any of the regulations set forth in this article and any other article of this chapter applicable to the same property, the more stringent regulation shall apply.
