The Burgess and Town Council of the Borough of Chambersburg do hereby grant unto the Baltimore and Cumberland Valley Railroad Extension Company[1] the right-of-way and the liberty and privilege to construct and operate the railroad of said company, with such sidings and switches as in the judgment of said company may be necessary, from the southern terminus of Water Street of said borough through, over, upon and along said street northward, to the northern terminus of said street, north of West King Street of said borough, provided that said company in constructing its said railroad, sidings and switches shall, in its cuttings and fillings in and upon said Water Street, conform to the grade shown by the profile hereto attached and made part of this ordinance, and provided, further, that said company in the construction of its said railroad, sidings and switches as aforesaid shall put, and shall at all times hereafter maintain, its crossings of all the streets and alleys of said borough in a safe and conveniently passable condition.
