The following definitions shall apply in the
interpretation and enforcement of this article:
Any person, firm, association, syndicate, co-partnership
or corporation being one or more of the record owners of the property.
Any individual, firm, association, syndicate, partnership,
or corporation.
That paved area beside the curb or edge of the roadway intended
for use by pedestrians.
The Township of East Cocalico, County of Lancaster, and Commonwealth
of Pennsylvania.
A.
From and after the effective date of this article,
no person or owner may shovel, throw, toss, blow or otherwise deposit
snow or ice from their lawn, driveway, sidewalk, or any other portion
of their real estate, onto any public road in East Cocalico Township.
Any person, or owner of any tract of land located
within East Cocalico Township violating the provisions of this article
shall pay a civil penalty of $100. In the event that the penalty for
a violation of the article has not been paid within 10 days of the
date of notice mailed to the person, or the owner upon whom the penalty
was imposed, East Cocalico Township may then initiate a civil enforcement
proceeding before a Magisterial District Judge. The civil enforcement
proceeding shall be initiated by a complaint or by such other means
as may be provided by the Pennsylvania Rules of Civil Procedure. In
addition to or in lieu of a civil action before a Magisterial District
Judge, East Cocalico Township may enforce the article in equity. In
any case where a penalty for the violation of the article has not
been paid within 10 days of the date of mailing the notice and the
person upon whom the penalty was imposed is found to be liable therefor
in civil proceedings, the violator shall be liable for the penalty
imposed, including additional daily penalties for continuing violations,
plus court costs and reasonable attorney's fees incurred by East Cocalico
Township in the enforcement proceeding.
