The Glenolden Fire Company Number 1, organized and existing in the Borough of Glenolden, Delaware County, Pennsylvania, is hereby designated as the officially recognized fire company of the Borough.
A. 
The fire company recognized by the Borough is hereby authorized to provide such services to the Borough as may be necessary for the protection of property and persons situated therein, which include, by way of example and not of limitation, the extinguishment and prevention of loss of life and property from fire, automobile accidents, medical emergencies, hazardous materials incidents and other dangerous situations.
B. 
The company may also provide nonemergency and public service functions, such as, again by way of example and not of limitation, removing water from property after storms and assisting in the removal, abatement and prevention of damage or injury to persons or property, whether through natural causes or man-made situations.
C. 
The company may also conduct and participate in such training activities and drills, either within or outside of the Borough, as may be deemed necessary by the officers of the company to maintain proficiency in providing service.
D. 
The company may also respond to calls and provide services to municipalities outside of the Borough.
E. 
When designated, the fire company may provide a past Fire Chief as the 5th District Fire Marshal or Assistant Fire Marshal. This Marshal or Assistant Marshal will be authorized by the Borough of Glenolden to act in that capacity and, as such, is covered under workmen's compensation policy.
In addition to actually participating in the activities of the fire company as authorized above or in going to or returning from any activity, the members of the fire company recognized by the Borough are also authorized to do the following things:
A. 
Function.
(1) 
Fight fires and provide emergency service in the Borough of Glenolden and wherever asked to assist, for the humane purpose of protection and preservation of person, place or thing.
(2) 
Engage in any type of drill, training, ceremony, practice, test or parade when duly called for or authorized by an officer or officers of the fire company.
(3) 
Engage in the performance of any other duty or activity authorized by any officer of the recognized fire company.
B. 
Coverage.
(1) 
The moment a fire alarm is sounded and/or a silent request is received.
(2) 
Fire drills and all parts thereof.
(3) 
Schooling for the betterment of fighting and prevention.
(4) 
Fire prevention:
(a) 
School demonstrations.
(b) 
Public demonstrations.
(c) 
Public open house.
(5) 
Care of trucks and/or apparatus.
(6) 
Fire meetings (while attending).
(7) 
Tag Day and/or fund-raising activities.
(8) 
Distributing and collecting raffle books.
(9) 
December, Santa Claus/fire prevention for children.
C. 
Services rendered.
(1) 
Fire aid.
(2) 
Rescues.
(3) 
Salvage.
(4) 
Ambulance service in emergency.
(5) 
Fire police work.
(6) 
Radio communication.
(7) 
Assistance of accidents.
(8) 
Control of crowds on both fire grounds and/or occasions of public or general assembly.
(9) 
Animal rescue.
(10) 
Abatement of conditions due to storms, flood and/or general peril.
(a) 
Pumping cellars.
(b) 
Helping with roofs.
(c) 
Helping with fallen trees.
(d) 
Any other duty that might be connected with the above-captioned.
(11) 
Abatement and/or removal of any hazards to safety or health as might be requested by call or the Borough Council.
(12) 
Participation in official holiday functions as directed by the Fire Chief or his designate.
The purpose of this chapter is to recognize Glenolden Fire Company Number 1 as the official fire company of the Borough and to state additional authorized activities for firefighters for workmen's compensation purposes.
This article shall be known as the "Glenolden Borough Fire Company Recovery Ordinance."
As used in this chapter, the following terms shall have the meanings indicated:
BOROUGH FIRE COMPANY
The recognized and designated fire company of the Borough of Glenolden.
EMERGENCY SERVICE
Includes firefighting, rescue, medical or other emergency service or combination thereof, to protect a person, the environment, critical infrastructure or property.
INSURANCE CARRIER
A company that offers and/or underwrites insurance policies.
INSURANCE POLICY
A document detailing the terms and conditions of a contract of insurance.
PERSON
An individual, organization, corporation, resident, and/or property owner requiring and receiving emergency services from the Borough Fire Company.
The Glenolden Borough Fire Company is authorized and directed by and through its officers and authorized representatives to ascertain what insurance policy coverage may be applicable and available under any given circumstance and to take all necessary and affirmative steps to apply for and receive reimbursement from any insurance carrier where a property owner or business owner is or may be insured to reimburse the Glenolden Borough Fire Company for any costs and/or expenses incurred for emergency services, supplies and/or equipment used for or provided to the property owner or business owner by the Glenolden Borough Fire Company.
The Borough of Glenolden further authorizes the Glenolden Borough Fire Company to recover reasonable costs from insurance carriers under application Insurance Policies of a Person for firefighting, use of firefighting materials and equipment and hazardous abatement materials involved in any and all hazardous abatement material incidents as are recoverable under the Hazardous Material Emergency Planning and Response Act.
However, and notwithstanding anything herein to the contrary, under no circumstances shall any Person receive a bill from the Glenolden Borough Fire Company for Emergency Services provided by the Borough Fire Company except in cases of false alarms and/or fires which are intentionally set by the Person.
This article shall be liberally construed to accomplish its purposes to compensate and/or reimburse the Borough Fire Company from insurance proceeds for costs and/or expenses incurred while providing Emergency Services pursuant to its duties for the Borough Fire Company.
The costs and fees as outlined in this article shall be recovered by the Borough Fire Company by direct billing by an attorney, collection service or agency contracted with the Borough Fire Company. In addition to the costs and fees as outlined in this article, the Borough Fire Company shall be authorized to collect any reasonable interest and administration fees for collecting the costs and fees.
In the event any Insurance Carrier or Person fails to pay any bill or invoice within 30 days of the mailing or delivery of such notice of charges, the Borough Fire Company or any attorney or agency contracted by the Borough Fire Company who mailed or delivered the bill or invoice may enforce the provisions of this article by filing a civil action at law in a court of competent jurisdiction for the collection of any amounts due to the Borough Fire Company, together with statutory interest, court costs, collection fees and reasonable attorneys' fees. The remedies provided herein shall be in addition to any other relief, remedies or penalties that may be appropriate or provided by law.
