As used in this chapter, the following terms shall have the meanings indicated:
EXHIBITION
All public circuses, carnivals, sideshows, exhibitions and amusements of similar nature, except such as are operated entirely by organizations within the Borough.
Hereafter any exhibition as hereinbefore defined is prohibited from opening, operating, setting up equipment or occupying land within the Borough unless and until a permit for such operation and occupancy shall be issued as herein provided.
The aforesaid permit may be issued in writing by the Borough Secretary, upon the direction of the Borough Council, signed by the said Borough Secretary and by the President of the Borough Council and sealed with the seal of the Borough, upon full compliance by the applicant with the following terms and conditions:
A. 
Before the issuance of any such permit, there shall be filed with the Borough Secretary such written information as he shall require with regard to the character of the proposed exhibition, the person, persons, organization, association or institution operating the said exhibition and the officers thereof, and likewise the said application shall be executed by some reliable organization, association or institution within the Borough which desires to sponsor the said exhibition. Permits shall be issued only to such applicants as are sponsored by organizations, associations or institutions of the Borough which, in the opinion of the Borough Council, are worthy and reliable, and the said application shall contain an agreement by the applicant that the amount deposited with the Borough over and above the permit fee hereinafter referred to may be used and expended by the Borough in placing the grounds occupied by the exhibition in a satisfactory condition after the closing of the said exhibition.
B. 
Before issuance of any such permit, the applicant shall deposit with the Borough Treasurer the sum of $100, of which sum the amount of $25 shall constitute a permit fee or charge and the balance shall be retained by the said Borough Treasurer pending the closing of the said exhibition and its vacation of the grounds within the Borough occupied by it. Upon the vacation of the said exhibition, the balance aforesaid shall be expended and applied against any repairs, cleaning or other work necessary to place the grounds formerly occupied by the said exhibition in a condition satisfactory to Borough Council; thereafter any unexpended balance shall be returned to the said applicant.

Any person or any officer, manager or agent of any firm, corporation or organization who shall violate any of the provisions of this chapter or who shall permit, encourage or assist in the violation of the provisions hereof or in the operation of any exhibition contrary to the terms hereof shall, upon conviction, be liable to a fine of not less than $25 and not exceeding $200, in addition to the costs of prosecution, and, upon default in payment of the fine and costs, to imprisonment not exceeding 30 days.
Each day's operation of any exhibition as hereinbefore defined contrary to the terms hereof shall and it does constitute a separate and distinct violation of this chapter, and each such day's operation after the first day shall, in addition to the penalties hereinbefore provided, be punishable by a further fine of not more than $100.
