That a certain document, three copies of which are on file with the Director of Code Enforcement of the Township of Marple, being marked and designated as the International Property Maintenance Code, 2015 Edition, as published by the International Code Council, be and is hereby adopted as the Property Maintenance Code of the Township of Marple in the Commonwealth of Pennsylvania for regulating and governing the conditions and maintenance of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use; and the is demolition of such existing structures as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Property Maintenance Code on file with the Director of Code Enforcement of the Township of Marple are hereby referred to, adopted and made a part hereof, as if fully set out in this article, with the additions, insertions, deletions and changes, if any, prescribed in § 214-9 of this article.

The following sections are hereby revised:
Section 101.1. Insert: TOWNSHIP OF MARPLE
Section 103.5 shall read as follows: The fees for activities and services performed by the department in carrying out its responsibilities under this code shall be as set forth in the Township's Schedule of Fees.
Section 112.4. Insert: $50: $1,000
Section 302.4 Insert: 10 inches.
Section 304.14 Insert: January 1 to December 31
Section 310 Insert new section to read in its entirety as follows:
Section 310 Refuse/Trash Containers
310.1 Location. Refuse/Trash Containers are permitted to be placed in a residential/commercial driveway under the following conditions.
1) A permit is obtained under the Township or UCC regulations.
2) Commercial permit permits a container may be placed in a commercial driveway until the permit is cleared or finalized or no longer than 120 consecutive calendar days whichever comes first.
3) Residential permit permits a container to be placed in a residential driveway for no longer than 20 consecutive calendar days.
4) An extension of time may be granted by obtaining approval from the Code Enforcement Department, up to a maximum of six consecutive months. Approval request shall be submitted to the Township at least one week before the expiration date.
310.2 Permit Required. It shall be the duty of any property or building owner, tenant, contractor or waste disposal or container rental company to obtain a permit issued by the Marple Township Code Enforcement Department before placing any refuse or trash container on any property in the Township.
310.3 Permit Fees. The fees for commercial or residential container permits shall be as set forth in the Township's Schedule of Fees.

The provisions of the Commercial Maintenance Code, Chapter 114, and the Housing Code, Chapter 170, which are not inconsistent with this article and which are not provided for in this article are not repealed by this article and shall remain in full force and effect.
That if any section, subsection, sentence, clause or phrase of this article is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this article. The Board of Commissioners hereby declares that it would have passed this article, and each section, subsection, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional.
Nothing in this article or in the Property Maintenance Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in § 214-10 of this article, nor shall any just or legal right or remedy of any character be lost, impaired or affected by this article.
