There is hereby created a Park and Recreation Board to be known as the "West Goshen Township Park and Recreation Board" which, for purposes of this chapter, shall be referred to herein as the "Board." The term "Supervisors" as used in this chapter shall mean the Board of Supervisors of West Goshen Township.

The Board shall consist of seven members who shall be appointed by the Board of Supervisors and shall serve for terms of five years or until their successors are appointed, except that the members of such Board first appointed shall be appointed for such terms that the term of not more than two members shall expire annually thereafter. Members of this Board shall serve without pay. All persons appointed shall serve their full terms unless voluntarily resigned or removed by the Supervisors for dereliction or neglect of duty. Vacancies on such Board occurring otherwise than by expiration of term shall be for the unexpired term and shall be filled in the same manner as original appointments.
The members of the Board established pursuant to this chapter shall elect their own Chairman and Secretary and select all other necessary officers, to serve for a period of one year.

The Board shall have power to adopt rules and regulations pertaining to the conduct of its business and meetings. The Board may recommend to the Supervisors the adoption of rules and regulations pertaining to the use by the public of park and recreation land owned by the township, but adoption of such regulations shall be within the jurisdiction of the Supervisors under Chapter 57 of this Code. The Board shall recommend to the Supervisors the employment or discharge and shall supervise all recreation personnel, but their salary and benefits shall be set by the Supervisors, provided that neither full- nor part-time employees who perform the duties of park maintenance shall be construed as recreation personnel. The Board of Supervisors shall also appoint an alternate member to serve an initial term of five years, and his successors shall thereafter be appointed for five-year terms. Vacancies shall be filled as provided in this section for members. The alternate member shall have the power to vote on all matters coming before the Park and Recreation Board when authorized by the Board's Chairperson in the absence of a regular member of the Board.

Subject to the approval of the Supervisors, the Board shall have the authority to equip, supervise and maintain parks, recreation areas and facilities and to conduct recreation programs thereon, provided that the Board shall have no jurisdiction to enter into any contract nor to incur any obligation which is binding upon the township other than current obligation contracts to be fully executed within the then-current fiscal year, subject to approval of the Supervisors, and within the budget appropriations made by the Supervisors.

A. 
All funds appropriated by the Supervisors and budgeted for operation of the Board shall be disbursed only by the fiscal disbursing officer of West Goshen Township upon vouchers issued by the Board, approved by the Supervisors and within the budget appropriations made.
B. 
Any funds received by the Board from sources other than budget appropriations shall be deposited by the Supervisors to the credit and for the use of the Board and disbursed as the above budget funds are disbursed, provided that funds received by gift, bequest or otherwise shall be disbursed in accordance with the terms of such gift or bequest or the terms of the acceptance thereof.
Meetings of the Board shall be held at such times and at such places as shall be determined by the rules and regulations of the Board.

It shall be the duty of the Board to submit an annual report to the Supervisors, including an analysis of the township's parks, recreation areas, facilities and recreation programs, with particular reference to the extent and adequacy of the programs and effectiveness in view of the public expenditures involved and the public needs to be met. The Board shall make such other and additional full and complete reports to the Supervisors at such other times as the Board shall deem necessary or when requested by the Supervisors.

All powers and duties which are now or may hereafter be provided by statute of the Commonwealth of Pennsylvania or by the ordinances of West Goshen Township relating to the development and operation of park and recreation systems and public parks and playgrounds shall be and remain vested in the Supervisors, except as otherwise herein provide.
