West Goshen Township, by the adoption of this article, evidences its intent to participate in Municipal Drug Task Force activities in cooperation with the Office of the Attorney General of the Commonwealth of Pennsylvania, which is designed to interdict the illegal use of and trafficking in narcotics and other illegal drugs and substances within its municipal boundaries and within the municipal boundaries of nearby communities with which it is authorized to cooperatively act pursuant to the Act.[1]

West Goshen Township is hereby authorized to enter into a Municipal Drug Task Force agreement with the Office of the Attorney General and the Bureau of Narcotics Investigation and Drug Control of the Commonwealth of Pennsylvania (the "agreement"), subject to approval of the form and content of the agreement by the Board of Supervisors. This agreement may, when approved by the Board of Supervisors, include intergovernmental cooperative activities with adjacent and nearby municipal governments as a part of a regional effort to interdict illegal drug activities.
West Goshen Township is hereby authorized to utilize the services of the West Goshen Township Police Department for such Municipal Drug Task Force activities as are approved by the Board of Supervisors, with the advice and consent of the West Goshen Township Chief of Police, under the terms and conditions set forth in the agreement and in compliance with the Municipal Police Jurisdiction Act, Act of June 15, 1982, P.L. 512, No. 141, as amended, 42 Pa.C.S.A. § 8951 et seq.
Pursuant to the terms of the agreement, which, upon its execution, shall be considered incorporated herein by reference, West Goshen Township, acting through its Chief of Police, shall establish appropriate procedures to comply with the agreement and relevant regulations, direction and guidance from the Office of the Attorney General. The agreement may be amended from time to time, subject to the approval of the Board of Supervisors, which agreement, as amended, shall automatically be incorporated as a part hereof without the necessity of amendment of this article.
The term of the agreement authorized by this article shall commence on the date it is completely executed by all parties thereto and may be terminated by West Goshen Township and any other party to the agreement at any time subject to 30 days' prior written notice to the other parties to the agreement.
The purposes and objectives of this article and the agreement authorized to be made and executed hereby include region-wide coordination of municipal police activities for the purpose of combating illegal narcotics, substance and drug, trafficking. The agreement shall be financed with funds provided by the Office of the Attorney General of the Commonwealth of Pennsylvania, subject to the appropriation and availability of funds for Task Force purposes. West Goshen Township shall have no financial responsibility or liability to provide funds to finance activities of the Task Force or any of its police officers participating in Task Force activities. Expenditure of Township funds shall be solely within the discretion of the Board of Supervisors.
West Goshen Township shall retain control and responsibility over the management, activities, control and direction of its police officer employees when involved in Municipal Drug Task Force activities, and all such police officer employees shall remain under the specific direction and control of the Chief of Police of West Goshen Township except as he shall otherwise direct during operations of the Task Force.
If any sentence, clause, section, or part of this article is for any reason found to be unconstitutional, illegal or invalid, such unconstitutionality, illegality or invalidity shall not affect or impair any of the remaining provisions, sentences, clauses, sections or parts hereof. It is hereby declared as the intent of the Board of Supervisors that this article would have been adopted had such unconstitutional, illegal or invalid sentence, clause, section or part thereof not been included herein.
This article shall be effective five days after enactment as by law provided.
