There is hereby adopted by the Board of Supervisors of West Goshen Township for the purpose of enacting and establishing minimum safety standards and regulations for the safe installation and maintenance of certain mechanical equipment situate within the Township, the International Mechanical Code, 2003 Edition, as now and as hereafter supplemented, reissued, amended and revised as published by the International Code Council, Inc. Not fewer than three copies of the International Mechanical Code, 2003 Edition, have been and now are filed in the Office of the Secretary of West Goshen Township, and the same is hereby adopted and incorporated as fully as if set out at length herein.
The following amendments, additions, deletions, and changes are hereby made to the International Mechanical Code, 2003 Edition:
A. 
Section 101.1 shall be amended by the deletion of the words "[NAME OF JURISDICTION]" and the replacement thereof with "West Goshen Township."
B. 
Section 103 shall be deleted in its entirety and replaced with the following: "SECTION 103. ENFORCEMENT."
C. 
Section 103.1 shall be deleted in its entirety and replaced with the following:
103.1 General. The Board of Supervisors shall, by resolution, appoint a Building Code Official who shall be certified by the Commonwealth of Pennsylvania under the Act. The Building Code Official shall be responsible for administration and enforcement of this Code. The Building Code Official shall be assisted by one or more building officials who shall also be appointed by the Board of Supervisors and certified by the Commonwealth of Pennsylvania under the Act. The Building Code Official and building officials shall be referred to in this Code as "Code Officials."
D. 
Section 103.2 shall be deleted in its entirety and reserved.
E. 
Section 106.5.2 shall be deleted and replaced with the following:
106.5.2 Fees and inspections/reinspections. The Board of Supervisors shall, by resolution, adopt a schedule of fees which shall be kept on file with the Township Secretary and shall be reviewed and revised as necessary by the Board of Supervisors."
F. 
Section 106.5.3 shall be deleted in its entirety.
G. 
Section 108.4 shall be amended to state as follows:
108.4 Violations and penalties. Any person who violates or permits the violation of any provision of this Code or shall fail to comply with any of the requirements thereof or who shall erect, install, alter or repair mechanical work in violation of the approved construction documents or directive of the Code Official, or of a permit, shall, upon conviction thereof in a summary proceeding brought before a District Justice, be guilty of a summary offense and shall be subject to the payment of a fine of not more than $1,000, plus the casts of prosecution. Upon default of payment thereof, the defendant may be sentenced to imprisonment in the county prison for a period of not more than 30 days. Each section or provision of this Code that is violated shall constitute a separate offense, and each day or portion thereof in which a violation of this Code is found to exist shall constitute a separate offense, each of which violation shall be punishable by a separate fine imposed by the District Justice of not more than $1,000, plus the costs of prosecution, and, upon default of payment thereof, the defendant may be sentenced to imprisonment in the county prison for a term of not more than 30 days.
H. 
Section 108.5 is deleted and replaced with the following:
108.5 Stop-work orders. The fine for violation of a stop-work order shall be not less than $100 nor more than $1,000, imposed and collected by the procedure specified in Section 108.4 of this Code.

Section 109, Means of Appeal, shall be deleted and replaced with the following:

SECTION 109
MEANS OF APPEAL
109.1 General. The West Chester Area Council of Governments (WCACOG) has formed a Board of Appeals, which shall hear and decide appeals of orders, decisions or determinations made by the Building Official relative to the application and interpretation of this Code. The Board of Appeals shall be appointed by the WCACOG and shall be governed by the rules and regulations adopted by the WCACOG. The Board of Appeals shall adopt rules of procedure for conducting its business and shall render all decisions and findings in writing to the appellant with a duplicate copy to the Building Official.
