[HISTORY: Adopted by the Board of Supervisors
of the Township of West Goshen 8-4-1954. Amendments noted where applicable.]
The following uses of and activities upon real
property in the Township of West Goshen are hereby declared to be
nuisances and are hereby prohibited:
A.
The use of any premises as a trash or garbage dump.
B.
The depositing or dumping of any amount of trash or
garbage upon the premises of another or upon public property.
D.
The accumulation or storage of junked or wrecked automobiles
as an automobile graveyard.
E.
The accumulation or storage of scrap metal or other
waste material as a junkyard.
F.
The storing of gasoline, kerosene or other petroleum
products in excess of 5,000 gallons, except by gasoline service stations
or petroleum products companies.
G.
Any use of or activity upon property that, by reason
of flames, smoke, odors, fumes, noise or dust, unreasonably interferes
with the reasonable use, comfort and enjoyment of a neighbor's property
or endangers the health or safety of the occupants of a neighboring
property.
H.
The excessive or unreasonable accumulation of scrap,
junk, trash or garbage upon any premises causing odors, fumes or unsightly
appearance to neighboring property owners.
I.
Unless otherwise permitted by the issuance of a permit by the Township for construction purposes pursuant to Chapter 70 of the West Goshen Township Code titled, "Streets and Sidewalks," the placement of any object, structure or property in a street or sidewalk which will obstruct, hinder or delay public travel thereon or constitute a safety hazard.

J.
Vibration that violates Chapter 78B of the Code of Ordinances of West Goshen Township. In the case of vibration that violates Chapter 78B of this Code, the violations and penalties provisions of Chapter 78B shall supersede the violations and penalties provisions of § 53-3 of this Code.

As used in this chapter, the following terms
shall have the meanings indicated:
The storage of two or more junked or wrecked automobiles
on any premises but shall not include the storage of wrecked automobiles
in a commercial district in connection with an automobile repair business,
where the wrecked automobiles are stored merely awaiting the repair
thereof in the immediate future.
The entire width between the boundary lines of every way
publicly or privately maintained when any part thereof is open to
the use of the public for purposes of vehicular travel, which also
includes a roadway open to the use of the public for vehicular travel
on the grounds of a college or university or public or private school
or public, historical or Township park, shopping center or private
roads in subdivisions or land developments utilized as a means of
egress and ingress by members of the traveling public.

The accumulation or storage of trash, refuse, rubbish or
garbage which has been brought upon or conveyed to a premises from
sources or locations other than the premises upon which said trash,
refuse, rubbish or garbage is stored or accumulated, whether the owner
of such premises is compensated for said dumping or not.

Any person who violates or permits the violation of any provisions
of this chapter shall, upon conviction thereof in a summary proceeding
brought before a District Justice under the Pennsylvania Rules of
Criminal Procedure, be guilty of a summary offense and shall be subject
to the payment of a fine of not less than $100 and not more than $1,000,
plus the costs of prosecution. In default of payment thereof, the
defendant may be sentenced to imprisonment in the county prison for
a term of not more than 30 days. Each section or provision of this
chapter that is violated shall constitute a separate offense, and
each day or portion thereof in which a violation of this chapter is
found to exist shall constitute a separate offense, each of which
violations shall be punishable by a separate fine imposed by the District
Justice of not less than $100 and not more than $1,000, plus the costs
of prosecution, or upon default of payment thereof, the defendant
may be sentenced to imprisonment in the county prison for a term of
not more than 30 days. All fines and penalties collected for the violation
of this chapter shall be paid to the Township Treasurer.
