The Board of Supervisors of West Goshen Township hereby adopts the International Plumbing Code, 2003 Edition, as now and as hereafter supplemented, reissued, amended and revised as published by the International Code Council, Inc. Not fewer than three copies of the International Plumbing Code, 2003 Edition, are filed in the office of the Secretary of West Goshen Township, and the same is hereby adopted and incorporated as fully as if set out at length herein.
The following amendments, additions, deletions, and changes are hereby made to the International Plumbing Code, 2003 Edition:
A. 
Section 101.1 shall be amended by the deletion of the words "[NAME OF JURISDICTION]" and the replacement thereof with the words, "West Goshen Township."
B. 
The heading of Section 103 shall be deleted in its entirety and replaced with the following: "SECTION 103 ENFORCEMENT."
C. 
Section 103.1 shall be deleted in its entirety and replaced with the following:
103.1 General. The Board of Supervisors shall by resolution appoint a Building Code Official who shall be certified by the Commonwealth of Pennsylvania under the Act. The Building Code Official shall be responsible for administration and enforcement of this Code. The Building Code Official shall be assisted by one or more building officials who shall also be appointed by the Board of Supervisors and certified by the Commonwealth of Pennsylvania under the Act. The Building Code Official and building officials shall be referred to in this Code as Code Officials.
D. 
Section 103.2 shall be deleted in its entirety and reserved.
E. 
Section 106.6.2 shall be deleted in its entirety and replaced with the following:
106.6.2 Fee schedule. The permit fees for all plumbing work provided for in this Code shall be paid in advance in accordance with the fee schedule established by resolution, duly adopted by the Board of Supervisors of West Goshen Township, as the same may from time to time be amended.
F. 
Section 106.6.3 shall be deleted in its entirety.
G. 
Section 108.4 is deleted and replaced with the following:
108.4 Violations and penalties. Any person who shall violate a provision of the Plumbing Code or shall fail to comply with any of the requirements thereof or who shall install, alter or repair a plumbing system in whole or in part in violation of this Code shall, upon being found liable therefor in a civil enforcement proceeding commenced by the Township, pay a fine of not more than $1,000, plus all court costs, including reasonable attorney fees incurred by the Township. If the defendant neither pays nor timely appeals the judgment, the Township may enforce the judgment pursuant to the applicable rules of civil procedure. Imposition of one fine for any violation or noncompliance shall not excuse the violation or noncompliance nor permit it to continue or be repeated, and all such persons shall be required to correct or remedy such violations or defects forthwith. Each section of the chapter violated shall constitute a separate offense, and each day or portion thereof in which a violation of this chapter is found to exist shall constitute a separate offense, each of which violations shall be subject to the imposition of a separate fine imposed by the District Justice of not more than $1,000, plus all court costs, including reasonable attorney's fees incurred by the Township, collectable as specified in this section.
H. 
Section 108.5 shall be amended by inserting "not less than $100" in the first blank and "nor more than $1,000" in the second blank.
I. 
Section 109 Means of Appeal shall be deleted in its entirety and replaced with the following:

SECTION 109
MEANS OF APPEAL
109.1 General. The West Chester Area Council of Governments (WCACOG) has formed a Board of Appeals, which shall hear and decide appeals of orders, decisions or determinations made by the Building Official relative to the application and interpretation of this Code. The Board of Appeals shall be appointed by the WCACOG and shall be governed by the rules and regulations adopted by the WCACOG. The Board of Appeals shall adopt rules of procedure for conducting its business and shall render all decisions and findings in writing to the appellant with a duplicate copy to the Building Official.
J. 
Section 305.6.1 shall be amended by inserting "36 inches" in both blank spaces.
K. 
A new Section 602.4 shall be added which shall read as follows:
602.4 Individual water supply. Connection to public water shall be required where the water main or any extension thereof is within 150 feet of the building. Otherwise, an on-site water well source shall be supplied.
L. 
Section 701.2 shall be amended by the addition of the following provision at the end of the existing section: "Connection to the West Goshen public sewer system shall be required where the sewer main or any extension thereof is within 150 feet of the building. Otherwise, an on-site sanitary sewer system shall be supplied."
M. 
Section 904.1 shall be amended by the insertion of "12 inches" in the "[NUMBER]" blank.
