A. 
No person shall have in his possession within the Village of Liberty an open or unsealed, unwrapped bottle or container of an alcoholic beverage while such person is in any public place, including but not limited to any public highway, public street, public sidewalk, public alley, public parking lot or area, except locations licensed for the sale of alcoholic beverages by the State of New York, with the intent to consume said alcoholic beverage in any public place or to have same consumed by another.
B. 
No person shall consume an alcoholic beverage on a public street, sidewalk or public parking area within the Village of Liberty, Sullivan County, New York.

The violation of this article shall constitute unlawful possession of alcohol, and a person violating same will be subject to arrest, prosecution and punishment as provided by the Village Law. Any person convicted of violating this article shall be subject to a fine of not less than $100 and not more than $250 or to imprisonment for a period not to exceed 15 days.
