A. 
This chapter shall be known as the "Personnel Ordinance."
B. 
It is hereby declared to be the personnel policy of the Town of Milton:
(1) 
That initial employment and continuation of such employment by the Town of Milton shall be based on merit and fitness, free of personal and political considerations.
(2) 
That just and equitable incentives and conditions of employment shall be established and maintained to promote efficiency and economy in the operation of the Town.
(3) 
That positions having similar duties and responsibilities shall be classified and compensated in a uniformly fair manner, giving due regard for such factors as hours worked per week and seniority.
(4) 
That appointments, promotions, and other actions requiring the application of merit principle shall be based on systematic tests and/or performance evaluations.
(5) 
That the tenure and amount of compensation of the employees shall be subject to good behavior, satisfactory performance of work and/or the availability of funds. (NOTE: Position and salary schedule as may be enacted by ordinance.)

A. 
All offices and positions of the Town are divided into the classified service and the exempt service.
B. 
The exempt service shall include:
(1) 
All elected officials, persons serving solely as members of committees, and Council.
(2) 
Volunteer personnel and personnel appointed to serve without compensation.
(3) 
Engineers, counsel, and other consultants rendering professional service.
(4) 
Such positions involving temporary or part-time employment as may be placed in the exempt service by the Council.
C. 
The classified service shall include all other positions of the Town that are not specifically placed in the exempt service by the provisions of this chapter. The classified service shall be further divided into management personnel and other personnel.
(1) 
The Town Clerk, Chief of Police, Chief of Maintenance Department and other positions that the Mayor and Council so create and designate shall be deemed management personnel. An integral part of their duties and responsibilities as management personnel is to attend each monthly regular Council meeting and to report to Council on the activities of their area of responsibility. Higher standards of expertise and managerial professionalism are expected of management personnel than of other personnel.
(2) 
The members of the classified service not hereinabove designated as management personnel shall be deemed "other personnel."
D. 
Upon the effective date of this chapter, each person whose work performance has been satisfactory and who then holds a position included in the classified service shall:
(1) 
Have permanent status if he has held his present position for at least six months immediately preceding the effective date of this chapter; or
(2) 
Serve a probationary period of six months, less the number of months already served, before acquiring permanent status if he has held his position for less than six months immediately preceding the effective date of this chapter, subject to the exemptions provided for in § 26-9.
E. 
Each temporary employee in the exempt service who shall have served six months on a full-time basis shall be notified that he will either become part of the classified service with permanent status or be continued on a temporary basis.
