The Town of Milton finds that it would be dangerous to the public health, safety, and welfare to permit swimming or bathing in the Broadkill River and Wagamon's Pond.
From and after the date of this chapter, it shall be unlawful for any person to bathe, swim, or wade or otherwise go into water of the Broadkill River and Wagamon's Pond, located within the corporate limits of the Town of Milton, or to enter said waters from lands located within the corporate limits of the Town of Milton to swim or bathe.
The following activities shall not be deemed bathing or swimming as defined in § 72-2:
A. 
Actual launching, or retrieving a boat or other recreational watercraft at the municipal boat launch ramp; and
B. 
Other boating activities as allowed by law.[2]
