The cemetery known as “Centennial Cemetery”
is hereby declared a public burial ground; and no person or persons,
society or congregation shall establish any other burial ground within
the corporate limits of said Village of New Haven. Said cemetery is
situated on the east half of the southwest quarter of Section 28 town
4 north of range 14 east and is described as follows: commencing 26
rods and 16 feet east of southwest corner of east 1/2 of southwest
1/4 of said section 28 town and range aforesaid, thence north 22 rods,
thence west 214 feet, thence north 10 rods, thence west 14 rods, thence
north 16 rods, thence east 46 rods, 13 feet and nine inches, thence
west 16 rods 13 feet and nine inches, thence south 32 rods to section
line, thence west on section line 50 feet to place of beginning and
containing 6, 30-160 acres of land (more or less).
No interment shall be made in any place within
the corporate limits of the Village of New Haven except in such cemeteries
as may be established by ordinance or resolution of the Village Council.
A.
There shall be appointed by the Council three trustees
who shall be freeholders and electors of said Village, who shall constitute
a Board of Cemetery Trustees. The three trustees shall hold their
offices for the term of three years, except that at the first appointment
one shall be appointed for one year, one for two years and one for
the term of three years from the second Monday of April when appointed,
and annually thereafter one trustee shall be appointed. The Council
may remove any trustee so appointed for inattention to his duties
or want of proper skill in or for the proper discharge of the duties
required of him or for any other good cause. The Board shall serve
without compensation. The members shall appoint one of their number
Chairman, and the Village Clerk shall be Clerk of the Board.
B.
The Board shall be subject to the directions and ordinances
of the Council, have the care and management of said Centennial Cemetery
and shall direct the improvement and embellishments of the grounds,
cause the same to be laid out in lots, avenues and walks, the lots
to be numbered and plats thereof to be made and recorded in the office
of the Village Clerk. The Board shall fix the price of lots and make
sales thereof.
C.
The conveyance of such lots shall be executed on
behalf of the Village by the Clerk and be recorded in his office at
the expense of the purchaser. The fee to be paid for such record shall
be $0.25.
The Board of Cemetery Trustees shall appoint
the necessary superintendents and employees for the cemetery, expend
the money provided for the care and improvement of the grounds, enforce
the ordinances of the Village made for the management and care thereof
and make such regulations for the burial of the dead and the care
and protection of the grounds, monuments and appurtenances of the
cemetery and the orderly conduct of persons visiting the grounds as
may be considered with the ordinances of the Village and the laws
of the state.
All monies raised for the cemetery by the Village,
and all monies received from the sale of lots therein or otherwise
therefrom, shall be paid into the Village treasury and constitute
a fund to be denominated the "Cemetery Fund"; said fund shall not
be devoted or applied to any other purpose except the purposes of
such cemetery. The Board of Cemetery Trustees shall report to the
Council annually on the first Monday in March, and as often as the
Council shall require, the amount of all monies received into and
owing to the cemetery fund and from what source and from whom and
the date, amount, items and purpose of all expenditures and liabilities
incurred and to whom paid and to whom incurred and such other matters
as the Council shall require, which report shall be verified by the
oath of the Clerk of the Board.
A.
The Board of Cemetery Trustees shall keep a record
of each interment made in said cemetery, the lot upon which the same
is made, the name of the person buried, and date of interment.
B.
The Board shall have the exclusive right to dig or
open graves within said cemetery, and all graves opened shall be under
the supervision of said Board or its employees.
The Board of Cemetery Trustees shall from time
to time adopt such rules and regulations for the government and control
of said cemetery as may be deemed necessary, which shall be submitted
to the Council for adoption. Upon their adoption and passage by the
Council, such rules and regulations shall have the force and effect
of ordinances.
The Village Council shall, on recommendation
of the Board of Cemetery Trustees, set apart a lot or lots in said
cemetery for interment of strangers and poor persons.
It shall be unlawful for any person or persons
to commit any nuisance, to injure, deface or destroy any tombstone,
monument, footstone, headstone or other device for the marking of
graves in said cemetery or to remove, injure or destroy any shade
or ornamental tree, plant, flower or shrub or any vase crock, bouquet,
floral design or any other ornamental device upon or about any grove
or lot in said cemetery, except from his or her own lot, or to encroach
upon any lot or part of a lot belonging to any other person or to
said Village in setting up any monument, stone or enclosure or in
grading or ornamenting any lot or part of lot, nor shall any person
deface, injure or destroy any fence about said cemetery or about any
lot therein.

Any person or persons convicted or a violation of or failure to comply with the provisions of this chapter before any court of competent jurisdiction shall be punished as set forth in Chapter 59, Municipal Civil Infractions, of the Code of the Village of New Haven.
