It shall be unlawful for any person to discharge directly or indirectly into the sewer system, or into any private sewer drain emptying into the sewer system, any wastewater, the characteristics of which do not conform to the concentration limits prescribed herein, or to discharge into the sewer system any toxic substances or any other objectionable material or substances as specified under this chapter, except upon written approval by the Mayor and Council and upon such terms and conditions as may be established by the Mayor and Council in the acceptance of the wastewater.
It shall be unlawful for any person to discharge or permit the discharge or infiltration into any public sewer any of the following:
A. 
Any liquid or vapor having a temperature higher than 150° F. (65° C.) or any substance which causes the temperature of the total wastewater treatment plant influent to increase at a rate 10° F. or more per hour, or a combined total increase of plant influent temperature to 100° F.; provided, however, that this subsection shall not apply to residential use, restaurants, or other duly licensed establishments where meals are prepared for consumption on or off the premises.
B. 
Any liquid containing fats, wax, grease or oils of mineral or petroleum origin, whether emulsified or not, in excess of 100 mg/l, or of animal or vegetable origin in excess of 300 mg/l, or containing substances which may solidify or become viscous at temperatures below 150° F. (65° C.).
C. 
Any water or wastes that contain more than 10 mg/l of hydrogen sulfide.
D. 
Any residues from petroleum storage, refining or processing, fuel or lubrication oil, gasoline, naphtha, benzene or other explosive or flammable liquids, solids, or gases in such concentration which would cause or potentially cause an explosive flammable or other hazardous condition.
E. 
Any substances that:
(1) 
Cause obstruction to the flow in sewers;
(2) 
Interferes with operation of treatment processes or facilities; or
(3) 
Causes excessive loading or overloading of treatment facilities; or
(4) 
Passes to the receiving waters without being effectively treated by normal wastewater treatment processes due to the incompatibility of the substance.
F. 
Any discharge (exclusive of domestic wastes) into public sewers of other solid or viscous substances, including but not limited to:
(1) 
Ashes.
(2) 
Cinders.
(3) 
Sand.
(4) 
Mud.
(5) 
Straw.
(6) 
Shavings.
(7) 
Metal.
(8) 
Glass.
(9) 
Rags.
(10) 
Paper products, either whole or ground by garbage grinders.
(11) 
Tar.
(12) 
Plastic.
(13) 
Wood or sawdust.
(14) 
Underground garbage.
(15) 
Paint residues.
(16) 
Bulk solids.
G. 
Any unusual concentrations of any constituent listed herein, which for any period of duration longer that 15 minutes exceeds more than three times the maximum permissible composite concentrations, or whose flow exceeds five times the average flow rates during normal operation.
H. 
Any garbage that has not been properly shredded to a degree that all particles can be carried freely under the flow condition normally prevailing in public sewers. Particles greater that 1/2 inch in diameter of its largest cross section plane are prohibited.
I. 
Any liquid having a pH lower than 6.0 or higher than 9.0, or having any other corrosive property capable of causing damage or hazard to structures, equipment and personnel of the sewage works.
J. 
Any wastewater having an inorganic dissolved solids concentration greater than 1,500 mg/l.
It shall be unlawful for any person to discharge or cause to be discharged any stormwater, surface water, groundwater, roof runoff, interior or exterior footing draining, subsurface draining, cooling water, or unpolluted industrial process waters to any sanitary sewer.
The concentration in wastewater of any of the following constituents shall be limited to the stated maximum permissible concentrations in order to be acceptable for discharge to the public sewers.

No heavy materials or toxic materials may be discharged into public sewers without a permit from the Mayor and Council specifying conditions of pretreatment, concentration, volumes, and other applicable provisions.
Any liquids containing toxic or obnoxious materials in sufficient quantity, either singly or by interaction with other wastes, to injure or interfere with any sewage treatment process, constitute an additional hazard to humans or animals, create a public nuisance or create any hazard in the receiving waters or the effluent of the sewage treatment plant are hereby prohibited. In the case of the discharge of a specific material by a user in amounts which are toxic, the Mayor and Council may impose separate or special concentration limits upon the user.
When appropriate local, state or federal authorities prohibit the discharge of any of the toxic substances described in this chapter or any other substance, the users may be required to utilize the best available technology to reduce the discharge of the substance.
No user shall discharge radioactive materials into public sewers without the permission of the Mayor and Council. The Mayor and Council may establish, in compliance with applicable state and federal regulations, regulations for discharge of radioactive wastes into public sewers. In no instance shall the active elements or their local concentrations permitted to be discharged into the sewers exceed the limits established.
When, in the opinion of the Mayor and Council, it is necessary to comply with this chapter, the owner shall provide, at his expense, such preliminary treatment as may be necessary to reduce the BOD and suspended solids concentrations or other objectionable characteristics or constituents to within the maximum limits provided for in this article, and/or to control the quantities and rates of discharge of such waters or wastes.
So far as is practicable, wastes may be discharged into the public sewers with or without pretreatment, provided the consent of the Mayor and Council is first obtained and the rules, regulations and standards herein prescribed are complied with in the judgment of the Mayor and Council.
Holding tank wastes shall be discharged only at locations approved by the Mayor and Council.
Written approval by the Mayor and Council is required for all new discharges of nondomestic wastes added to the public sewer system.
Removal equipment for grease, oil, sand and other prohibited matters shall be provided when, in the opinion of the Mayor and Council, they are necessary for the proper handling of liquid wastes containing grease in excessive amounts, of any flammable wastes, sand and other harmful ingredients; except that such equipment shall not be required for private living quarters of dwelling units. All equipment shall be of a type and capacity approved by the Mayor and Council and shall be located as to be readily and easily accessible for cleaning and inspection. Where installed, all grease, oil and sand removal equipment shall be maintained by the owner, at his expense, in continuously efficient operation at all times.
Where preliminary treatment facilities are provided for any waters or wastes, they shall be maintained continuously in satisfactory and effective operation by the owner at his expense. To aid the Mayor and Council, the owner, subsequent to the commencement of operation of any pretreatment facilities, shall make periodic reports to the Mayor and Council of a type, kind or capacity of an installation shall not relieve the owner of the responsibility of revamping, enlarging or otherwise modifying an installation to accomplish its intended purpose to the degree necessary to comply with the rules and regulations.
No statement in this article shall be construed as preventing any special agreement or arrangement between the Mayor and Council and any industrial concern whereby an industrial waste of unusual strength or character may be accepted by the Mayor and Council for treatment, subject to payment, in accordance with Article V, by the industrial concern and subject to the approval of the Mayor and Council.
The prohibitions contained in this Article III shall pertain to surges, accidents or peak periods of discharge, and are not to be deemed as an average level over a particular period, it being expressly recognized by the Mayor and Council that such peak output levels can be detrimental to the effective treatment of wastewater. In the event that the particular circumstances of a person or industry require special consideration, they may apply for written approval by the Mayor and Council for computation based upon a particular period, pursuant to the procedures to seek such approval more fully set forth within this chapter.
The provisions of Article III herein above shall apply to all wastewater discharges or the permitting of such discharges by all persons or industries, whether said persons or industries have exceeded the prohibited levels or have discharged prohibitive products, substances or constituents in the past. In the event such person or industry is not in compliance, they shall be deemed in violation of this chapter and subject to the penalty set forth in Article VII of this chapter.

All structures located within the corporate limits of the Town of Milton which have discharges of domestic wastes and nondomestic wastes shall be connected to the community sewer. A private sewer or septic system is specifically prohibited without a prior written waiver from the Mayor and Town Council. Any such waiver shall only be granted based upon the applicant's showing of good cause, and the Mayor and Town Council may impose conditions on the waiver, including but not limited to those related to volume and length of operation. Noncompliance with any conditions of the waiver shall automatically invalidate the waiver.
The maintenance and upkeep of the main sewer line (system) and sewer lateral to the clean out is the responsibility of the Town of Milton. From the clean out into the property is the responsibility of the property owner.
