The purpose of this article is to provide for the parking of charter buses within the Town.
As used in this article, the following terms shall have the meanings indicated:
BUSES
All motorbuses and autobuses transporting passengers for hire, except the regularly scheduled buses of a public transportation utility, which maintains, operates and supervises a terminal, and private parking area within the corporate limits of the Town shall not be included within such definition. Such regularly scheduled buses of such public transportation utilities are hereby exempt from this article. Chartered buses of such public transportation facility are not exempt from the provisions of this article and are included within this definition.
PUBLIC PARKING LOT
Include any parking lot located within the Town, which is maintained and operated by the Town.
STREET
Includes any thoroughfare, avenue, boardwalk, boulevard, lane, alley, or other public way within the corporate limits of the Town.
A. 
Any person desiring to park in a municipal bus parking lot shall obtain a reservation from the Town Clerk of the Town. The application shall be made, in writing, at least seven days prior to the reservation date desired. It shall be accompanied by a parking fee for each bus, for each day on which the parking reservation is required. For applicable fees, please consult the currently effective Town of Milton Fee Schedule. Upon receipt of the parking fee, the Town Clerk shall determine the availability of the requested spaces for the days for which an application is made. If space is available, the Town Clerk shall mail or cause to be mailed to the applicant a parking permit or permits for the spaces requested. All buses transporting persons for hire to the Town shall have such permits prominently displayed on the right side of the windshield at all times while within the corporate limits of the Town.

B. 
The number of reservations issued shall be determined by the number of available spaces.
The discharge and loading of such buses shall be only at the municipal bus parking lot or private parking lots, as provided in this article, except the Town Clerk may, for good cause shown, from time to time, and specific cases only, upon prior notice, allow loading and discharge of passengers at some other location.
Buses parked or standing in the area designed in this article must be, if unattended, locked and in no instance shall the operators of said buses allow the motors to be running when the bus in not moving or preparing to move.
The operator of the bus shall be responsible for compliance with the requirements of this article concerning parking, loading and discharging of passengers.
The owner of any private parking lot, including hotel, motel, and restaurant parking lots, may apply for and be issued a permit for parking of buses on their respective private parking lot, applications for the permits being made at least seven days prior to the date that the parking is requested. Any bus parked on such parking lot pursuant to this article shall be, if unattended, locked and in no instance shall the operator of said bus allow the motor to be running when it is not moving or preparing to move. A separate permit shall be required for each bus.
Nothing contained in this article shall be construed as prohibiting buses transporting participants in a parade to load or discharge said participants in designated areas provided a permit has been issued for the parades.
A. 
Any person violating any of the provisions of this article shall be deemed guilty of a misdemeanor and, upon conviction in a court of competent jurisdiction, shall be fined not less than $25 nor more than $100 or imprisoned for a period not more than 20 days, or both, and shall pay the cost of prosecution.
B. 
For the purposes of this article, the parking of each bus in violation of the provisions of this article shall be deemed to be a separate offense under the terms of this article.
