A. 
If there is any violation of this chapter, the Code Enforcement Officer or other person authorized by law to enforce this chapter shall serve a notice of violation upon the owner, operator, occupant, lessee, sublessee, licensee, sublicensee, as applicable, having care or control of any such building, structure or parcel of land. The notice shall inform the owner and (if applicable) the operator, occupant, lessee, sublessee, licensee or sublicensee having the care or control of such building, structure or parcel of land that:
(1) 
He is the owner, operator, lessee, sublessee, licensee, sublicensee, occupant or person having the care or control of any such building, structure or parcel of land;
(2) 
A description of the premises and its location;
(3) 
The manner in which the property is in violation of this chapter; and
(4) 
He, she or it must forthwith remedy the violation of this chapter.
B. 
The proper service of any notice required by this chapter shall be made by personal service or certified mail upon the record owner and (if applicable) the lessee, operator, sublessee, licensee or sublicensee, occupant or person having the care or control of such building, structure or parcel of land, at his, her or its last known address. Service shall be deemed complete upon the personal service or mailing, as aforesaid.
C. 
In the event that the Code Enforcement Officer or other person authorized by law to enforce this chapter has determined that a violation of this chapter exists, the Code Enforcement Officer may remedy the violation or cause the violation to be remedied, upon which the Code Enforcement Officer shall file with the Village Clerk a sworn statement as to the total actual cost of the Village of Liberty in inspecting, processing and remediating or removing the violation of this chapter, including but not limited to the wages (including all benefits) of all employees of the Village of Liberty who are involved with such inspection, processing and remediation or removal, which sum shall be added to and form a part of the taxes next to be assessed and levied upon such building, structure or parcel of land, and shall pay interest as unpaid taxes. The Village may effect the filing of such sworn statement of the Code Enforcement Officer with the Clerk of the County of Sullivan, which shall thereupon constitute a lien and privilege on the real property and shall remain in full force for the amount due, together with interest and penalties thereon, until final payment has been made. The foregoing charges and costs shall be collected and enforced by the Village of Liberty in the same manner as taxes or, in the discretion of the Village Board of Trustees, may be the basis of an action in a Court of competent jurisdiction against any and/or all persons and/or entities responsible or liable for such violation of this chapter, for a money judgment for all such sums due and owing, together with all costs, disbursements, penalties and interest authorized by law.
The failure to comply with any provision of this chapter shall be deemed a violation which shall be punishable by a fine of no less than $50 and no more than $250 for each violation. Each day that a violation exists shall be deemed a new and separate violation.
