There is hereby adopted by the Board of Trustees of the Village of Liberty for the purpose of establishing a Housing Code containing minimum housing standards applicable to residential premises including one- and two-story dwellings, multiple dwellings, mobile homes and mobile home courts in the Village of Liberty, that certain code known as the "Model Housing Code" from Volume 2 of the publication "Housing Codes, the Key to Housing Conservation," published in 1960 as a result of a demonstration project conducted by the New York State Division of Housing and Community Renewal in cooperation with the Housing and Home Finance Agency, save and except such portions as are hereafter deleted, modified or amended; of which code not less than three copies have been and now are filed in the office of the Clerk of the Village of Liberty and the same are hereby adopted and incorporated as fully as if set out at length herein; and from the date on which this ordinance shall take effect, the provisions thereof shall be controlling within the limits of the Village of Liberty.
The code hereby adopted shall be enforced by the Chief Officer of the Village of Liberty Housing Authority, his assistant and inspectors.
As used in this ordinance and the code adopted thereby, the following terms shall have the meanings indicated:
AGENCY
The Village of Liberty Housing Authority.
MUNICIPALITY
The Village of Liberty.
The Chief Officer of the Village of Liberty Housing Authority shall have the power to modify any of the provisions of the code hereby adopted upon application in writing by the owner or lessee, or his duly authorized agent, when there are practical difficulties in the way of carrying out the strict letter of the code, provided that the spirit of the code shall be observed, public safety secured and substantial justice done. The particulars of such modification when granted or allowed and the decision of the Chief Officer of the Village of Liberty Housing Authority thereon shall be entered upon the records of the department and a signed copy shall be furnished the applicant.
Whenever the Chief Officer of the Village of Liberty Housing Authority shall disapprove an application or refuse to grant a permit applied for, or when it is claimed that the provisions of the code do not apply or that the true intent and meaning of the code have been miscontrued or wrongly interpreted, the applicant may appeal from the decision of the Chief Officer of the Village of Liberty Housing Authority to the Board of Trustees of the Village of Liberty within 30 days from the date of the decision appealed.
Every person who shall fail to comply with a violation order issued by the agency within the time limit stated thereon shall be guilty of disorderly conduct and, upon conviction, shall be punished by a fine of not less than $25 or by imprisonment for not less than five days nor more than 30 days, or both.
All former ordinances or parts thereof conflicting or inconsistent with the provisions of this ordinance or of the code hereby adopted are hereby repealed.
The Board of Trustees of the Village of Liberty hereby declares that should any section, paragraph, sentence or word of this ordinance or of the code hereby adopted be declared for any reason to be invalid, it is the intent of the Board of Trustees of the Village of Liberty that it would have passed all other portions of this ordinance independent of the elimination herefrom of any such portion as may be declared invalid.
This ordinance shall take effect and be in force from and after its approval as required by law.
