[HISTORY: Adopted by the Board of Commissioners of the Township of Radnor 2-25-1974 by Ord. No. 1564 as Ch. 14 of the 1974 Code. Amendments noted where applicable.]
It is the desire and intention of the Board of Commissioners to organize an Authority under the Municipality Authorities Act of 1945 (the Act approved May 2, 1945, P.L. 382, as amended and supplemented).[1]

The name of the proposed Authority shall be "Radnor Township Municipal Authority."
The proposed Articles of Incorporation for the proposed Authority are as follows:
ARTICLES OF INCORPORATION
TO THE SECRETARY OF THE
COMMONWEALTH OF PENNSYLVANIA:
In Compliance with the Municipality Authorities Act of 1945 (the Act approved May 2, 1945, P.L. 382, as amended and supplemented),[1] the Township of Radnor, Delaware County, Pennsylvania, pursuant to an Ordinance duly enacted by the Board of Commissioners of said Township authorizing the formation of a municipal Authority, does hereby certify:

The name of the Authority shall be "RADNOR TOWNSHIP MUNICIPAL AUTHORITY."

The said Authority is formed under the "Municipality Authorities Act of 1945" (the Act approved May 2, 1945, P.L. 382, as amended and supplemented) for all the purposes authorized by said Act.

No other Authority has heretofore been organized under the Municipality Authorities Act of 1945, as amended and supplemented, or under the Act approved June 28, 1935, P.L. 463,[2] and is in existence in or for the Township of Radnor, Delaware County, Pennsylvania, either acting alone or jointly with other municipalities. However, concurrently with the organization of this Authority the Township of Radnor is organizing a Parking Authority under the provisions of the Act of June 5, 1947, P.L. 458, as amended and supplemented.[3]

The name of the incorporating municipality is "The Township of Radnor, Delaware County, Pennsylvania."
The names and addresses of the members of the Board of Township Commissioners, the municipal authorities of the Township of Radnor, Delaware County, Pennsylvania, are as follows.[4]

The Board of the Authority shall consist of five members, each of whom shall be a citizen of the Township of Radnor.

The names and addresses and the term of office of the first members of the Board of said Authority are as follows.[5]
The term of office of each member of the original Board shall commence on the date of his appointment and the fixed terms of each such member as set forth above shall be computed from the first day of January next succeeding the date of incorporation of the Authority. Whenever a vacancy in the Board has occurred or is about to occur by reason of the expiration of the term of any member, or has occurred by reason of death, resignation or otherwise, the Board of Commissioners of the Township of Radnor, Delaware County, Pennsylvania, shall appoint a member for a term of five years to fill a vacancy occurring by reason of the expiration of a term or for the unexpired term when the vacancy has otherwise occurred. Members whose terms have expired shall hold office until their successors have been appointed and may be appointed to succeed themselves.
IN WITNESS THEREOF the Township of Radnor, Delaware County, Pennsylvania, has executed these Articles of Incorporation by its proper officers thereunto duly authorized and under its municipal seal this .......... day of .................... A.D. 1956.

The members of the original Board of Radnor Township Municipal Authority named in the proposed Articles of Incorporation are hereby specifically appointed members of said Board for the terms of office set after their respective names. The term of each member of the original Board shall commence on the date of his appointment, and the fixed term of each such member as set forth in said Articles shall be computed from the first day of January next succeeding the date of incorporation of the Authority.
The Articles of Incorporation of the proposed Authority, in substantially the form set forth in § 56-3 of this article, shall be executed on behalf of the Township of Radnor by the President of the Board of Township Commissioners and under its Municipal Seal attested by the Township Secretary, and such officers are hereby authorized, empowered and directed to acknowledge the same on behalf of the Township of Radnor, to file said Articles with the Secretary of the Commonwealth of Pennsylvania, to give notice thereof and to do all things necessary and appropriate to effect and establish said proposed Authority in conformity with the provisions of the Municipality Authorities Act of 1945, as amended and supplemented.[1]

The first projects to be undertaken by said Authority shall be the acquiring, holding, constructing, improving, maintaining and operating, owning and leasing, in the capacity of either lessor or lessee, of a Township Building and sewers, sewer systems or parts thereof. Said Authority shall not undertake any other project unless and until the Board of Commissioners of the Township of Radnor shall enact a further ordinance authorizing said Authority to undertake another project or projects.
The Radnor Township Municipal Authority, as established in Article I, is hereby authorized to acquire, hold, construct, improve, maintain, operate, own or lease, in the capacity of either lessor or lessee, projects pertaining to parking spaces, playgrounds, parks and recreation grounds and facilities.
This Article shall be construed to enlarge the provisions of § 56-6 of Article I to the extent herein specified, and in all other respects said Article I shall remain in full force and effect.
