This chapter shall be known and may be cited as "Local Law No. 3 of the Year 1977, Changing the Terms of Office of the Members of the Town of Greece Board of Zoning Appeals."
The Town Board of the Town of Greece, through the power granted to it under the appropriate provisions of the Town Law, has created a Board of Zoning Appeals and has appointed members to said Board. The Board of Zoning Appeals shall consist of a maximum of seven members. The Board of Zoning Appeals has been given certain powers, such as hearing appeals from decisions of the Building Inspector, granting special permits under specific circumstances and granting variances under the proper circumstances from Chapter 211, Zoning, of the Code of the Town of Greece. In order to provide the people of the Town of Greece a more frequent opportunity to serve on such an important Board in the Town of Greece, which Board affects the lives and property of many residents, the Town Board has determined to exercise the authority given to it under the laws of the State of New York, to amend the Town Law to reduce the duration of the terms during which a Zoning Board member holds office.
As used in this chapter, the following terms shall have the meanings indicated:
MEMBER OF THE BOARD OF ZONING APPEALS
A person appointed to the Zoning Board of the Town of Greece by the Town Board of the Town of Greece, pursuant to the authority granted the Town Board under § 267 of the Town Law.
TERM OF OFFICE
The period of time a member of the Board of Zoning Appeals, appointed by the Town Board, shall hold office.
[Amended 7-23-2020 by L.L. No. 3-2020]
Any person appointed as a member of the Zoning Board of Appeals by the Town Board of the Town of Greece after the effective date of this chapter shall serve for a term of three years from the date of appointment. If a vacancy shall occur other than by expiration of term, it shall be filled by the Town Board by appointment for the unexpired term. As authorized by New York State Town Law and the Municipal Home Rule Law, the Town Board may appoint alternate Zoning Board of Appeals members for the purposes of substituting for a Zoning Board of Appeals member in the event such member is unable to participate for any reason.
This chapter shall amend § 267(1) of the Town Law as it applies to the Town of Greece, pursuant to the authority granted the Town Board of the Town of Greece by the laws of the State of New York, including § 10 of the Municipal Home Rule Law.
