The purpose of this chapter is to provide more effective measures that deal with liabilities, improper design and hazards and to make the residents aware that some activities to be performed within our rights-of-way may have to be addressed by the Department of Public Works before the work is done, to protect the lives and property of the people using the public highways in the Town of Greece, to protect Town roads from damage and deterioration and to allow for orderly development along the highways of the Town of Greece.
A. 
No person shall damage in any way, open or cause to be opened by cutting or digging the surface, pavement or soil in any highway right-of-way or public place under the jurisdiction of the Town without first obtaining a permit from the Superintendent of Highways.
B. 
Written application shall be made upon a form to be provided by the Town, which shall be filed with and approved by the Highway Superintendent.
Any excavation in the highways, rights-of-way or public property of the Town shall be properly guarded or barricaded at all times, and adequate and sufficient warning devices shall be installed and maintained to warn the public, as provided for in the New York State Department of Transportation Manual of Uniform Traffic Control Devices, latest revision.
All excavated materials shall be removed, following which all openings shall be carefully backfilled for their entire length, width and depth in the highway area. All backfill must meet the Town Specifications for Construction of Utilities and Roadways, latest revision.
All surplus earth and construction debris shall be cleaned up and removed from the highway daily and the highway left in a neat and orderly condition daily to the satisfaction of the Highway Superintendent or his/her designee.
All restoration work shall be inspected and approved by the Highway Superintendent or his/her designee.

No permit shall be issued under this chapter by the Superintendent of Highways until the applicant shall have first placed on file with said Superintendent of Highways, without cost to the Town of Greece, satisfactory evidence of general liability insurance for bodily injury and property damage in the amounts of not less than $1,000,000 per occurrence and $3,000,000 annual aggregate, except that when the work to be performed exceeds the value of $1,000,000, then the amounts of general liability insurance must not be less than $3,000,000 per occurrence and $5,000,000 annual aggregate, and satisfactory evidence of workers' compensation insurance in the amount of not less than $100,000 per accident or disease and $500,000 policy limit, and satisfactory evidence that said insurance has been approved as to form, correctness, and adequacy by the Town of Greece to insure the Town of Greece against loss, injury or damage arising out of the granting of the permit or from any negligence or fault of said applicant, his or her agents, servants, employees or contractors, in connection with any work related to the permit.
