This chapter shall be known as the "Skateboard Law of the Town of Greece.”
The purpose of this chapter is to provide for the safety, health and general welfare of the residents of this Town and the users of the streets and sidewalks of this Town. By this chapter, the Town seeks to prevent any residents or users of certain streets and sidewalks from sustaining personal injury or property damage as a result of the use and operation of skateboards within the Town of Greece.
As used in this chapter, the following terms shall have the meanings indicated:
SKATEBOARD
A single, narrow platform which is mounted on wheels, which control the direction of movement thereof while being used, operated or ridden.
A. 
Use restrictions.
(1) 
No person shall use, operate or ride a skateboard in areas designated in § 168-5, Restricted areas, Subsections A and B.
(2) 
No person shall use, operate or ride a skateboard on a public street or sidewalk:
(a) 
In a careless manner without due caution and circumspection;
(b) 
While endangering or in a manner to create a risk or danger to any person or property; or
(c) 
In any manner so as to impede or interfere with pedestrian or vehicular traffic.
B. 
Reflective clothing and other equipment.
(1) 
No person shall operate a skateboard at nighttime unless he or she is wearing reflective clothing, which shall be visible from a distance of not less than 50 feet.
(2) 
"Reflective clothing" shall be defined, for the purposes of this chapter, as any shirt, vest, jacket or any other readily visible piece of apparel equipped with a reflective surface, such as phosphorescent tape or an equivalent reflective surface.
Skateboards will not be allowed in or on:
A. 
All Town-owned or -leased parking lots.
B. 
Any parking lots available for public use whether privately or publicly owned, provided that the Town has received written verification from the owner requesting enforcement of this chapter.
C. 
The Lake Ontario State Parkway and the 390 Expressway.
D. 
Main thoroughfares: Bennington Drive, Bonesteel Street, Britton Road, Denise Road, Dewey Avenue, Edgemere Drive, English Road, Frisbee Hill Road, Island Cottage Road, Janes Road, Latta Road, Ling Road, Long Pond Road, Manitou Beach Road, Manitou Road, Maiden Lane, Mill Road, Mt. Read Boulevard, North Avenue, North Greece Road, Payne Beach Road, Peck Road, Ridgeway Avenue, Stone Road, Stonewood Avenue, Straub Road, Vintage Lane, Weiland Road and West Ridge Road.
A. 
Any police officer observing a person under 16 years of age violating any provision of this chapter shall take possession of the skateboard.
B. 
Any police officer observing a person 16 years of age and older violating any provisions of this chapter shall take possession of the skateboard, and said person shall be subject to penalties set forth in this chapter.
Any person who violates any provision of this chapter shall be subject to the following storage and handling fee schedule as outlined below:
A. 
First violation. A storage and handling fee of $15 shall be paid to the Town Clerk's office prior to the release of a confiscated skateboard.
B. 
Second and each subsequent violation. A storage and handling fee of $25 shall be paid to the Town Clerk's office prior to the release of a confiscated skateboard.
In addition to any penalties set forth herein, any violation of any of the provisions of this chapter shall be subject to a fine of not more than $250.

This chapter shall be enforced by a duly authorized police officer.
