The Building Inspector is hereby empowered to issue permits for electrical installations to licensed electrical contractors and to make inspections of electrical work.

A. 
The Building Inspector is empowered and authorized to deputize in any instance any regular electrical inspector of any authorized electrical inspection agency to inspect any electrical installation as is referred to in § 113-11 hereof and to report on the same to the Building Inspector, provided that such inspection and report is without compensation from the Village.
B. 
As used in this chapter, the term "electrical inspector" shall mean any person who now or hereafter inspects electrical components, equipment and systems used in buildings and structures to determine the compliance of such electrical components, equipment and systems with the applicable provisions of the New York State Uniform Fire Prevention and Building Code promulgated pursuant to Article 18 of the Executive Law. All duly authorized electrical inspectors must be authorized and deputized by the Building Inspector as agents of the Village of Rye Brook to make inspections and reinspections of electrical installations, and to approve or disapprove the same. In no event, however, will the cost or expense of such inspections and reinspections be a charge against the Village of Rye Brook.
C. 
Any person desiring to be deputized as an electrical inspector in the Village of Rye Brook shall submit an application to the Building Inspector, or his or her designee, on a form provided by the Village, along with the following application materials:
(1) 
A copy of a valid and subsisting certificate from the International Association of Electrical Inspectors and certification from the NYS Department of State, Division of Building Standards and Codes, to perform inspections of one- and two-family homes and/or commercial establishments. If such person is a firm, corporation or other entity, the subject certificate must be provided for each employee for whom authorization is sought to perform electrical inspections. The original certificate(s) and/or qualifications must be displayed to the Building Inspector.
(2) 
Proof of insurance showing workers' compensation coverage, general liability coverage, and any other coverage deemed necessary in such amounts as the Building Inspector shall deem appropriate. The Village of Rye Brook shall be named as an additional insured and certificate holder on the certificates of insurance.
(3) 
An agreement on a form approved by the Village Attorney whereby the inspector agrees to defend, indemnify and save harmless the Village of Rye Brook, its officers, agents, attorneys and employees from and against any claim of loss, liability or damage by any person arising as a result or in connection to any electrical inspection performed by the electrical inspector.
(4) 
A fee schedule for charges to be incurred by a property owner or contractor for an inspection, which fees may not be charged to the Village.
(5) 
Payment of a processing fee as set forth by resolution of the Village Board of Trustees in the Village License and Fee Schedule, which may be amended.
D. 
The Building Inspector shall have the sole authority, in his or her absolute discretion, to deputize an electrical inspector. In addition, the Building Inspector shall have the sole authority, in his or her absolute discretion,to limit the number of deputized electrical inspectors in the Village of Rye Brook.
E. 
Based upon the submission above, the Building Inspector shall determine the types of buildings for which an electrical inspector shall be authorized to inspect and shall maintain a list of types of buildings in the Village's Building Department specifying same.
F. 
The authority granted to any electrical inspector in accordance with this chapter shall expire on December 31 of every year, but shall be subject to reauthorization within 30 days prior to such expiration upon submission of the following documents:
(1) 
An affidavit from the electrical inspector whose authorization is expiring, confirming that their certificate from the International Association of Electrical Inspectors and/or certification from the NYS Department of State, Division of Building Standards and Codes, remains valid and subsisting and confirming their address, telephone number and email;
(2) 
Certificates of insurance; and
(3) 
Payment of a renewal fee as set forth by resolution of the Village Board of Trustees in the Village Fee Schedule.
G. 
Revocation.
(1) 
The authority granted to any electrical inspector in accordance with this section may be revoked by the Building Inspector upon a finding that:
(a) 
The documents and materials submitted to the Village by the electrical inspector contained misrepresentations and/or false statements.
(b) 
The electrical inspector improperly or incompletely performed an inspection.
(c) 
The electrical inspector failed to comply with the provisions of this chapter.
(d) 
The required insurance policies have lapsed or any required certificate is invalidated.
(e) 
The electrical inspector failed to comply with the laws of the State of New York and the rules and regulations issued in accordance therewith.
(f) 
The electrical inspector failed to comply with the rules and regulations of the National Electric Code and the National Electric Safety Code.
(g) 
The electrical inspector failed to comply with reasonable standards of conduct for agents of the Village, failed to treat members of the public with respect and failed to act in a professional manner.
(h) 
The electrical inspector has been convicted of a felony.
(2) 
Any disputes as to the bases of revocation of such authority shall be referred to the Village Board, whose determination shall be binding.
The Building Inspector or Fire Department is hereby empowered to disconnect any electrical current, after notification to the owner or his recognized agent or the occupant, when the current, in his or its opinion, is dangerous to life or property or when it may interfere with work of the Fire Department.
