This chapter shall be known as the "Parks Law
of the Village of Rye Brook."
The purpose of this chapter shall be to preserve
the public peace and good order on lands operated as public parks
by the Village of Rye Brook and to contribute to the safety and enjoyment
of the users of such parkland by regulating the hours of use, the
use of motorized vehicles and by prohibiting certain activities inimical
to customary park recreation use.
A.
The parks shall be open to residents of Rye Brook
and their guests.
B.
The Department of Recreation and Parks of the Village
of Rye Brook is charged with the administration of this chapter and
the posting of signs designating park lands within the Village of
Rye Brook. The rules and regulations set forth herein shall apply
to and be in effect in all parks under the control, supervision and
jurisdiction of the Department of Recreation and Parks of the Village
of Rye Brook.

For the purpose of this chapter, the terms used
herein are defined as follows:
The members of the Advisory Council on Parks and Recreation that were appointed pursuant to Chapter A258 of the Code.
An organization exempt from the payment of income tax under
the applicable provisions of the Internal Revenue Code of 1954 and
any amendments thereto.
The grounds, buildings thereon, waters therein and any other
property necessary for the operation thereof and constituting a part
thereof, which are now or hereafter will be maintained, operated and
controlled by the Village of Rye Brook for public park purposes.
Any individual, firm, partnership, corporation or association
of persons, and the singular number shall include the plural.
The burning of a lighted cigar, cigarette, pipe or any other
matter or substance which contains tobacco, cannabis, cannabinoid
hemp or other product, including the use of an electronic smoking
device that creates an aerosol or vapor.

Every device in, upon or by which a person or property is
or may be transported.

A.
No person shall be permitted to remain, stop or park
within the confines of any park in the Village of Rye Brook between
7:00 p.m. and 6:00 a.m. from October 1 through March 31 and between
9:00 p.m. and 6:00 a.m. from April 1 through September 30 each year,
except in case of an emergency, with special permit of the Superintendent
of Parks and Recreation or as otherwise stated in the Village Code.

From
April 1 through September 30 each year, no person shall be permitted
to remain, stop or park within the confines of Pine Ridge Park in
the Village of Rye Brook between 10:30 p.m. and 6:00 a.m.
B.
In case of an emergency or when, in the judgment of
the Village Administrator after consultation with the Superintendent
of Parks and Recreation, the public interest demands it, any portion
of a park may be closed to the public until permission is given to
reopen it.

A.
A permit must be obtained from the Advisory Council
on Parks and Recreation for the following uses and activities:
(1)
The use of a park building located at the park site.
(2)
Picnicking on park grounds and/or the use of any playing
fields or other park facilities by groups larger than 24 persons.
(3)
Camping, sleeping or lodging within a park where allowed.
(4)
Cooking food within a park.
(5)
Posting or displaying any sign, banner or advertisement
of any kind within a park.
(6)
Using any loudspeaker or other sound-amplifying equipment.
(7)
Picnicking or cooking in any area not designated by
the Advisory Council on Parks and Recreation for that purpose or making
or kindling any fire, except in places provided therefor and subject
to such regulations as may be prescribed.
(8)
Begging, hawking, peddling or soliciting within any
park.
B.
Permits shall be issued by the Superintendent of Parks
and Recreation.
C.
All permit applicants must be residents of Rye Brook
and 18 years of age or older. All permits must be signed prior to
use of a park facility or prior to the activities for which a permit
is obtained. The signer of a permit shall be responsible for all damages
to park facilities or contents thereof and shall agree to indemnify
the Village of Rye Brook for such damages. A nonresident may obtain
a permit at the discretion of the Superintendent of Parks and Recreation.
D.
All permits issued shall be in writing by the Superintendent
of Parks and Recreation and shall be subject to park rules and regulations.
A permit to do any act shall authorize the same only insofar as it
may be performed in strict accordance with the written terms and conditions
thereof and not in violation of any law or rule or regulation governing
parks. Any violation of any term or condition thereof, or any law
or rule or regulation governing parks, shall constitute grounds for
revocation of said permit by the Advisory Council on Parks and Recreation,
whose action therein shall be final. No permit for the same purpose
shall be issued to the person whose permit has been revoked during
the year in which such revocation is made.
E.
Upon obtaining a permit, the applicant shall pay a
permit fee to the Superintendent of Parks and Recreation in an amount
to be established by the Board of Trustees. The current License and
Fee Schedule is on file in the Village Clerk's office. Such fee may
vary according to the activity permitted and the facilities used.
Nonprofit service organizations shall be exempt from the payment of
such fee.

F.
Any group desiring to reserve park facilities may
apply to the Superintendent of Parks and Recreation for a permit.
Any group with a permit shall be given preference to use ballfields
and other park facilities during the hours of the permit and shall
have the right to exclude others from the reserved ballfields or park
facilities during the hours of the permit.

A.
Park buildings may only be used upon the obtaining
of a permit as provided herein.
B.
Rules and regulations particular to each park's building
or pavilion shall be established by the Advisory Council on Parks
and Recreation. Nonobservance of such rules and regulations shall
constitute a violation.
C.
All permits for park use must be picked up at the
Village Office at least 72 hours prior to use.

Nonobservance of the following park regulations
shall constitute a violation:
A.
Games. No person shall engage in potentially dangerous
games involving thrown or propelled objects, such as footballs, baseballs,
horseshoes, roller skates, golf balls or similar objects, except in
areas designated for such usage and then only subject to such rules
as may be prescribed by the Advisory Council on Parks and Recreation.
All games of any description must be conducted in a safe and orderly
manner, and no rough or boisterous practices will be allowed.
B.
Hunting, fishing and molesting wildlife. No person
shall take or attempt to take any fish from or send or throw any animal
or thing into a pond or any of the waters of the parks, except with
permission of the Advisory Council on Parks and Recreation. No person
shall kill, injure or unnecessarily disturb any fish, waterfowl, birds
or animals. No person within the confines of a park shall hunt, pursue
with dogs, trap or in any other way molest any wild bird or animal
found within the confines of the park or rob or molest any bird nest
or take the eggs of any bird.
C.
Preservation of property and natural features. No
person shall injure, deface, disturb or befoul any part of a park
or any building, sign, equipment or other property found therein,
nor shall any tree, flower, shrub, rock or other mineral be removed,
injured or destroyed.
D.
Littering, rubbish, garbage, sewage and noxious material.
No person shall, without the specific written consent of the Advisory
Council on Parks and Recreation, bring into, leave behind or dump
any material of any kind in the park, except the refuse, ashes, garbage
and other material of a picnic, camp or other permitted activity,
and such material shall be deposited in receptacles or pits provided
for such purposes. Refuse is not to be dropped, thrown or scattered
on park property. Tin cans, bottles or other glassware or metallic
substances containing sharp edges shall be deposited in park receptacles.
E.
No person shall bring or permit an animal to be in
a park, except as otherwise permitted by the Code of the Village of
Rye Brook.

F.
No motorized vehicle shall be permitted in a park
except on a roadway or designated parking area.
G.
Writing, painting or carving on any tree, bench or
park structure shall not be permitted.
H.
Ascending or landing with any aircraft, including
gliders or parachutes, except in an emergency situation, or engaging
in stunt flying or parachute landing or model airplane flying or model
rocket launching using liquid or solid fuel as a propellant shall
not be permitted.
I.
Carrying any shrub, axe, saw, shovel or spade within
a park, violating the regulations of the Advisory Council on Parks
and Recreation relating to any building or place, damaging any notice
posted by order of the Advisory Council on Parks and Recreation or
depositing materials in or upon any park or park road shall not be
permitted.
J.
Moving or carrying any tables or equipment found within
a park for park use to a different area of the park shall not be permitted.
K.
Smoking
or carrying a lighted cigar, cigarette, pipe, or any other matter
or substance which contains tobacco, cannabis, cannabinoid hemp or
other product, and/or the use of an electronic smoking device that
creates an aerosol or vapor, shall not be permitted. No person shall
dispose of any smoking materials, including, but not limited to, cigarette
or cigar butts and filters, in any place other than a receptacle designated
for the deposit of such items.

No parent, guardian or custodian of any minor
shall permit or allow him or her, as the case may be, to do any act
which would constitute a violation of this chapter. Nonobservance
of this section shall be a violation.[1]

Any person damaging any park property shall
be liable for any damages incurred.
