A.
No parking. When parking is prohibited by this chapter
or by officially posted signage, it shall be unlawful for any person
to park a vehicle, whether occupied or not, but a person may stop
or stand temporarily for the purpose of, and while actually engaged
in, loading or unloading merchandise or passengers.
B.
No standing. When standing is prohibited by this chapter
or by officially posted signage, it shall be unlawful for any person
to stand or park a vehicle, whether occupied or not, but a person
may stop temporarily for the purpose of, and while actually engaged
in, receiving or discharging passengers.
A vehicle shall not be permitted to:
A.
Stand, unless halted by traffic, on any street except
at the curb.
B.
Stop with its left side to the curb except on a one-way
street.
C.
Occupy any street so as to obstruct traffic.
D.
Stop so as to obstruct a crossing.
E.
Stand backed up at an angle to the curb except while
actually loading or unloading said vehicle.
F.
Stand in such a position as to prevent another vehicle
stopped or parked at the curb from moving away.
G.
Stand within 10 feet of a fire hydrant, crosswalk
or corner.
H.
Stand within 25 feet of any street excavation or obstruction,
except that when such excavation or obstruction is at or close to
the curb, the vehicle may stand at the curb, but not so as to obstruct
traffic.
I.
Stand, stop or wait where contrary to officially posted
signage.

A vehicle, when left unattended or parked on
a grade or incline, shall have the brake effectively set and the wheels
turned at an angle against the curb, and not parallel to the curb.

A.
The Board of Trustees may, by resolution, establish
and enforce such regulations governing the parking of vehicles on
public highways within the Village as it considers necessary for public
convenience and which do not unduly restrict the orderly movement
of traffic or endanger the public safety.
B.
Special parking restrictions in a specified area shall
be indicated by signs authorized by the Village of Rye Brook, and
drivers must at all times comply with the directions thereon.
C.
A vehicle shall not be parked on any street or highway
for the purpose of making repairs, except those of a minor nature
in a case of emergency.
D.
A vehicle shall not be parked or left unattended on
any street in front of a driveway.
E.
In any parking space where the area to be occupied
by any vehicle is indicated by lines on the pavement or curbing, a
vehicle must be parked within such lines.
F.
A vehicle shall not be parked in the same location
on any public street or highway within the Village of Rye Brook for
more than 72 consecutive hours. For the purposes of this provision,
"in the same location" shall include any location within 50 feet of
the location of the vehicle at the commencement of the seventy-two-hour
time period.

A.
Up to 18 parking licenses that authorize overnight parking in the
parking lot serving Garibaldi Park (hereinafter "Garibaldi Parking
Lot") and separately up to six parking licenses serving the Public
Works and Parks Facility on Ellendale Avenue (hereinafter "Ellendale
Parking Lot") shall be available to the residents of the Village of
Rye Brook. Proof of residency is required. No more than two licenses
for any of the combined two parking lots shall be issued to residents
who reside at the same address. The fee for the parking licenses shall
be established by the Board of Trustees by resolution. These licenses
shall not be available to park commercial vehicles or taxis.
B.
The provisions of this section shall apply only to the first 18 parking
licenses issued for the Garibaldi Parking Lot and the first six parking
licenses issued for the Ellendale Parking Lot. One parking license
must be reserved for an individual with a handicapped permit or disability
license plate to park in the designated handicapped parking space
in the Garibaldi Parking Lot. The Village Clerk will set a deadline
for the filing of an application for a parking license.

If the Village Clerk receives more applications for parking
licenses than spots designated, 18 licenses for the Garibaldi Parking
Lot and six for the Ellendale Parking Lot, by the application deadline,
a lottery will be conducted to determine who will receive the parking
licenses and the order of the applicants on the waiting list for the
parking licenses. The date and location of the lottery shall be noticed
as determined by the Village Administrator, and the lottery shall
be conducted in public. After the lottery, the parking licenses will
be issued upon the receipt of the applicable fee from the selected
applicants.
(2)
If the Village Clerk receives less than the maximum number of
applications for a parking license at each parking location by the
application deadline, the parking licenses will be issued on a first-come,
first-served basis until all licenses have been issued. After the
last licenses are issued for the Garibaldi Parking Lot and separately
for the Ellendale Parking Lot, the Village Clerk will start a waiting
list for the parking licenses that will be added to on a first-come,
first-served basis.
C.
The parking licenses may be renewed each year by filing a new application
and paying the applicable fee by October 1. It is the responsibility
of the holder of a license to renew it. No renewal will be processed
after October 1. Any parking license that is not renewed by October
1 shall be issued to the person at the top of the waiting list upon
his or her payment of the applicable fee.
D.
After all the available parking licenses have been issued for the
Garibaldi Parking Lot and separately for the Ellendale Parking Lot,
the residents of the Village of Rye Brook may be added to the waiting
list on a first-come, first-served basis by filing a parking license
application with the Village Clerk.
E.
At the Garibaldi Parking Lot, a parking license issued by the Village
Clerk is valid from November 15 to March 15 each year, and the holder
of such license may park their vehicle in one of the designated licensed
18 parking spaces on two parking lanes on the westernmost side of
the parking lot only between the hours of 10:30 p.m. and 7:30 a.m.
Only an individual with a parking license who has a current handicapped
permit or a disability license plate may park in the handicapped parking
space in the Garibaldi Parking Lot. The vehicles licensed to use the
Garibaldi Parking Lot parking spaces shall be parked with their headlights
directed to the western side of the parking lot.
F.
At the Ellendale Parking Lot, the parking license issued by the Village
Clerk under this section shall be valid for up to one year beginning
on November 15 and ending November 14, and the holder of such license
may park their vehicle in one of the designated licensed six parking
spaces only between the hours of 10:30 p.m. and 7:30 a.m. The vehicles
licensed shall be parked with their headlights facing Ellendale Avenue.
G.
The parking licenses shall be revocable at the discretion of the
Village Administrator. The holder of a parking license may not assign,
license or otherwise transfer it to another party nor otherwise permit
anyone other than a member of their immediate family to use the authorized
parking space. By accepting a parking license, the holder thereof
agrees to:

Indemnify and hold harmless the Village of Rye Brook for any
injury or property damage he or she sustains as a result of the use
of the Garibaldi Parking Lot or the Ellendale Parking Lot pursuant
to the license; and
(2)
Indemnify the Village for any damages it sustains as a result
of the holder's use of the Garibaldi Parking Lot or Ellendale Parking
Lot pursuant to the parking license.
H.
The parking licenses shall be subject to the conditions set forth
in this section of the Village Code as well as the conditions set
forth in the permit application form adopted by the Village Clerk.
I.
All determinations concerning the issuance and/or revocation of a
parking license shall be made by the Village Administrator in their
sole discretion, and their determination shall be final.

A.
The Village Clerk will issue annual parking permits, at no charge, to employees of the Port Chester High School. Proof of employment by the Port Chester High School is required to obtain a permit. These parking permits merely provide permission for their holders to park in the restricted parking areas designated in § 240-19.1B of this Code. The parking permits do not represent or guarantee that there is or will be parking available for the permit holder along College Avenue, Neuton Avenue or Tamarack Road.
B.
The parking permits issued pursuant to Subsection A of this section of the Village Code shall be renewed each school year by filing a new application. It is the responsibility of the holder to renew the permit and conspicuously display the permit in the vehicle.
C.
The parking permits issued pursuant to Subsection A of this section of the Village Code may be revoked at any time. The holder of such a parking permit may not assign, license or otherwise transfer it to another party nor otherwise permit another party to use it.
D.
By accepting a parking permit issued pursuant to Subsection A of this section, the holder thereof agrees to indemnify, defend and hold harmless the Village of Rye Brook for any injury, death or property damage that occurs as a result of the use of the parking permit.
E.
The parking permits issued pursuant to Subsection A shall be subject to the conditions set forth in this section of the Village Code as well as the conditions set forth in the permit application form adopted by the Village Clerk.
F.
All determinations concerning the issuance and/or
revocation of a parking permit shall be made by the Village Administrator
in his sole discretion, and his determination shall be final.
During plowing and clearing of snow from the
public streets or highways, or in the event that a snow emergency
has been declared in Westchester County, no vehicle shall be parked
on any side of any public street or highway in the Village of Rye
Brook, with the exception of the following streets or highways: West
Street.

A.
Clear, unobstructed roadways shall be maintained in
areas established by the Building Inspector and/or Fire Chief or their
designated representatives in areas necessary for access to places
of public assembly, structures of public access, office buildings
and parking lots of 10 or more spaces and residential subdivisions
of 10 or more units of housing. Such roadways shall be designated
as "fire lanes" by the Building Inspector and/or the Fire Chief or
their designated representatives.
B.
Types of fire lanes.
(1)
Fire Lane A: Emergency access area, located in the
immediate vicinity of structures and fire hydrants for emergency use
only.
(2)
Fire Lane B: Emergency routes, streets, roads or driveways
on private property customarily used by emergency apparatus that lead
to emergency access areas and fire hydrants.
C.
Markings.
(1)
Fire Lane A:
(a)
Curb side and top shall be painted traffic yellow
and paved area crosshatched out four feet from curbs. Crosshatching
shall have six-inch-wide lines at an angle of 45° to the curb
extending outward in the direction of oncoming traffic. Lines shall
be two feet apart.
(b)
Standard NO PARKING-FIRE LANE signs shall be
placed every 50 feet. They shall be no more than two feet from the
curb and no lower than six feet and no higher than eight feet from
the street grade to the bottom edge of the sign. Signs should be at
an angle of 30° to 45° to oncoming traffic, where practicable.
(2)
Fire Lane B:
(a)
Designated emergency route. Curb side and top
shall be painted traffic yellow on the side of the street leading
to the structure and Fire Lane A.
(b)
Standard NO PARKING-FIRE LANE signs shall be
placed every 100 feet. Signs shall be no lower than six feet and no
higher than eight feet from the street grade to the bottom edge of
the sign.
D.
Signage. In residential areas, designated Fire Lane
B signs spaced every 50 feet to 75 feet can be substituted for yellow
curbs with the approval of the Building Inspector and/or Fire Chief.
E.
Modifications. The Building Inspector or his designated representative, after consultation with the Fire Chief, shall have the right to modify all the requirements set forth in Subsection B and the painting and crosshatching requirements set forth in Subsection C herein and/or substitute therefor alternative markings and designation requirements for curbs and pavement in fire lanes and/or on emergency routes. Said modifications shall be made in the exercise of the Building Inspector's discretion, on a case-by-case basis, when such modifications are deemed appropriate for the particular facts and circumstances. Any such modifications will be established by the Building Inspector, in writing, and will be applicable only to the particular premises in question.
F.
Compliance. Any individual or company who owns or
manages a place of public assembly or public access or an office building
shall complete the markings required herein within 15 days of receiving
notice of the designated fire lanes from the Building Inspector and/or
the Fire Chief or their designated representatives and shall be required
to keep and maintain the designated roadways and fire lanes free and
clear from any obstructions, including but not limited to motor vehicles.
G.
Penalties.
(1)
Parking in a fire lane shall be a violation of this
section and shall be punishable by a fine of not less than $50 but
no more than $250 per offense or by imprisonment not to exceed 15
days, or both.
(2)
Any individual or company who owns or manages a place of public assembly or public access or an office building who fails to keep appropriate markings on the designated fire lanes or who fails to keep and maintain the designated roadways and fire lanes free and clear from any obstructions, including but not limited to motor vehicles, shall be guilty of a violation of this section and subject to the penalties provided in § 1-17 of Ch. 1, General Provisions, for each day on which the fire lanes remain unmarked or obstructed.

A.
Notwithstanding any other provisions of this chapter,
it shall be unlawful for the operator, owner or lessee of a truck,
trailer, semitrailer, tractor, house coach or omnibus to stand, stop
or park on any public highway within the Village and leave such truck,
trailer, semitrailer, tractor, house coach or omnibus unattended by
a person capable of operating or removing it for a period longer than
necessary to load or unload passengers or freight.
B.
The provisions of this section, however, shall not
apply in the case of an emergency to state, county, Village and town
highways; not to agents or employees of public service corporations
when engaged in the erection of poles, the stringing of wires or the
repair, construction or inspection of lines, conduits or other structures
along the state, county, Village or town highways; not to persons
engaged in the construction, reconstruction or repair of the state,
county, Village or town highways or roads.
