As used in this article, the following terms shall have the
meanings indicated:
The meaning as defined in the Vehicle and Traffic Law of
the State of New York.
The meaning as defined in the Vehicle and Traffic Law of
the State of New York.
All roads and highways within the Town of Montgomery owned
and maintained by the Town of Montgomery.
The meaning as defined in the Vehicle and Traffic Law of
the State of New York.
It shall be unlawful for any person to interfere with, impede,
obstruct, hinder, interrupt or delay any vehicle or equipment engaged
or used in the operation of plowing snow or of removal of snow from
any Town highways or from any part thereof within the Town of Montgomery.
It shall be unlawful for any person to place, park or leave
any automobile, truck or other vehicle on any Town highway after a
fall or precipitation of snow and thereafter until the snow has been
removed or cleared from such Town highways, unless such automobile,
truck or other vehicle is at all times attended by and in charge of
a person capable of operating it.
A.
When any automobile, truck or other vehicle is parked or abandoned
on any Town highway after a fall or precipitation of snow so as to
interfere with, impede, obstruct, hinder, interrupt or delay the operation
of plowing or removal of snow, said automobile, truck or other vehicle
may be removed by the Town Superintendent of Highways.
B.
The Town Superintendent of Highways is hereby authorized to remove
automobiles, trucks or other vehicles from Town highways which are
upon said highways in violation of this article by use of his own
equipment, or he may engage the services of independent tow truck
operators to perform this removal.
C.
After such removal, the Town Superintendent of Highways may store
such automobile, truck or other vehicle in a suitable place, at the
expense of the owner. Such owner or person in charge of the automobile,
truck or other vehicle may redeem the same upon payment of the amount
of all expenses actually and necessarily incurred in effecting such
removal, such charges not to exceed $25, together with any charges
for storage, such storage charges not to exceed $2 per day or fraction
thereof.
A violation of this article or any provision thereof shall be
deemed an offense against this article as provided by § 135,
Subdivision 2, of the Town Law. Any person convicted of a violation
of this article shall pay a fine of $10 for the first offense and
shall pay a fine of $20 for each subsequent offense. All fines shall
be in addition to the charges for removal and storage of any vehicles
removed from Town highways.
The Town of Montgomery and/or the Town Superintendent of Highways
or any independent tow truck operator engaged by said Town Superintendent
of Highways shall not be responsible for any damage that may be suffered
by any automobile, truck or other vehicle which is removed from the
Town Highways pursuant to this article.
