[HISTORY: Adopted by the Board of Trustees of the Village of Mount Kisco 11-21-1989 as L.L. No. 12-1989. Amendments noted where applicable.]
The purpose of this chapter is to provide for the acquisition and subsequent preservation as natural green space of a certain parcel of unimproved real property located on North Bedford Road in the Village/Town of Mount Kisco by means of the establishment of a local improvement district pursuant to § 10 of the Municipal Home Rule Law and Article 22 of the Village Law, whereby the cost of such acquisition and preservation may be apportioned and assessed in part, upon the lands benefited thereby.
The Board of Trustees of the Village/Town of Mount Kisco does hereby find and declare as follows:
A. 
The preservation of natural and open green space in the Village/Town of Mount Kisco is important to the health, safety and welfare of the residents of the village/town.
B. 
There are only a few such parcels remaining in private ownership within the village/town.
C. 
The parcel which is the subject of this chapter is located on the main north-south street of the village/town, just to the north of the central business district.
D. 
This parcel is significant because of its preservation, in conjunction with the village-owned green space on the west side of North Bedford Road, will ensure the existence of a natural green corridor along this portion of North Bedford Road.
E. 
The preservation of this property will benefit the village/town as a whole and, to an even greater degree, the lands linked to the property by frontage on North Bedford Road, Grove Street Extension or the north side of Brookside Avenue by maintaining the green vista beautifying the approach to those lands and preventing the lands from being impacted by further development of the property.
F. 
The preservation of this parcel as envisioned herein cannot be achieved by any means other than the purchase of property by the village/town.
G. 
In light of the benefits to be derived therefrom, it is just and equitable that 75% of the cost of the improvements authorized herein be apportioned and assessed upon the lands benefited thereby and that 25% of such cost be borne by the Village/Town of Mount Kisco.
The Village Manager is hereby authorized to purchase for preservation as natural green space the parcel of real property located on North Bedford Road in the Village/Town of Mount Kisco. known and designated as Lot 69.82-01-01 on the Tax Map of the Village/Town or Mount Kisco.
The cost of the local improvements authorized herein are to be borne as follows: 25% by the Village/Town of Mount Kisco, and 75% by the lands benefited thereby, as defined in § 78-5 of this chapter.
The Board of Trustees hereby finds that the following lands, which shall hereafter constitute the North Bedford Road Green Space Preservation District, will be benefited by the local improvements authorized herein:
A. 
All those parcels having frontage on, ingress from or egress to North Bedford Road between Brookside Avenue and Barker Street, including all residential parcels in a planned multifamily development, the common areas of which have such frontage, ingress or egress.
B. 
All those parcels having frontage on the north side of Brookside Avenue.
C. 
All those parcels having access from the northerly side or easterly end of Brookside Avenue, which such parcels are identified on the Tax Map of the Village/Town of Mount Kisco as parcels:

The Village Manager is hereby authorized and directed to prepare a map showing the lands determined herein to be benefited by the authorized local improvement, to file a copy of such map in the office of the Village Clerk and to determine the cost of such local improvement.

The portion of the cost of the local improvements authorized herein which is to be borne by the lands benefited thereby is hereby apportioned and assessed against those lands in accordance with their assessed value as set forth in the village assessment roll which is based upon the taxable status of property as of January 1, 1990, and in accordance with the apportionment and assessment, and map thereof, filed in the office of the Village Clerk, of the Village/Town of Mount Kisco.
