[HISTORY: Adopted by the Board of Trustees of the Village of Mount
Kisco 6-23-1997 by L.L. No. 3-1997. Amendments noted where applicable.]
It has been the experience of other municipalities that tattooing has
led to increased cases of serum hepatitis. It has also been their experience
that regulatory measures have proven ineffective in eliminating this health
risk because of the inability to supervise tattooing establishments at all
times. The Village/Town of Mount Kisco (the "village") also lacks the resources
and personnel to supervise tattooing establishments on an ongoing basis. Accordingly,
the Board of Trustees finds that in the village, as in other communities,
a ban on tattooing except for medical purposes is the only feasible means
of protecting the public against disease from this source.
A.
It shall be unlawful for any person to tattoo a human
being within the village, except that tattooing may be performed for medical
purposes by a person licensed to practice medicine or osteopathy.
B.
Any tattooing establishment operating in the village
as of the effective date of this chapter can be continued in accordance with
all applicable laws and rules. At the time any such establishment(s) ceases
to operate or if there is a change of ownership of such establishment(s),
this chapter shall be applicable to said establishment(s).
An offense against the provisions of this chapter shall be punishable
by a fine of not more than $250 or by imprisonment for not more than 15 days,
or both.
