Editor's Note: This local law supersedes Town
Law § 23(1) in its application to the Office of Town Engineer.
There is hereby established, pursuant to § 20(2)(a)
of the Town Law of the State of New York, the office of Town Engineer
in the Town of North Greenbush. Said Town Engineer is hereby granted
and invested with all of the powers and duties of a Town Engineer
under § 32-a of the Town Law of the State of New York.
The term of office of Town Engineer shall be
from the date of appointment to December 31, 2005. On January 1, 2006,
or thereafter, the Town Board may establish the office by resolution
in accordance with Town Law, subject to the terms of this section.
The Town Board shall fix the salary for the
term of the Town Engineer upon the effective date of this article.
The person holding the office of Town Engineer
in the Town of North Greenbush need not be a resident nor an elector
of the Town of North Greenbush; provided, however, that such person
shall reside in the county in which such Town is located or an adjoining
county within the State of New York.
