It is the intent of the Town of North Greenbush,
as an exercise of its police power, to promote the general health,
safety and welfare of the residents of the town by enacting this chapter
since it is the finding of the Town Board that the possession of open
containers of alcoholic beverages by persons on certain public lands,
except under controlled conditions, is detrimental to the health,
safety and welfare of the residents of the Town of North Greenbush.
As used in this chapter, the following terms
shall have the meanings indicated:
CONTAINER
Any bottle, can, glass, cup or similar article containing
any alcoholic beverages.
PUBLIC PLACE
A place to which the public or a substantial group of persons
has access, and includes but is not limited to highways, streets,
shopping centers, parking lots, transportation facilities, schools,
places of amusement, parks, playgrounds, parking areas, hallways,
lobbies and any other places open or used by the general public. "Permitted
public places" shall be those "public places" where the use and consumption
of alcoholic beverages is authorized pursuant to a permit or license
issued by the Alcoholic Beverage Control Law or permission of the
Town Board.
No person shall carry, transport or have in
his possession in any public place, other than permitted public places,
any open, resealed or partly empty bottle, can, container or similar
article containing an alcoholic beverage of any kind or description
as defined by § 3 of the Alcoholic Beverage Control Law.
Violations of this chapter shall constitute
a violation as defined in the Penal Law of the State of New York.
The penalties for violation of this chapter shall be as provided in the general penalty provisions, Chapter
1, Article
II, of the Code of the Town of North Greenbush.
