No person shall engage in business as an auctioneer or conduct an auction in the village without first obtaining a license therefor.

A. 
A basic annual fee, as set out in Chapter 175, § 175-4, is required as a condition precedent to the granting of an auctioneer's license.
B. 
A fee, as set out in Chapter 175, § 175-4, in addition to the basic fee, shall be due and payable for each and every day during which a licensed auctioneer conducts an auction or acts as an auctioneer. Such payment shall be made to the Treasurer, on or before the next business day following such auction, at his office in the Municipal Building.
Sections 206-10 and 206-11 of this article notwithstanding, no fee shall be required to be paid for a permit to conduct an auction directed to be held within the village by the order of any court of competent jurisdiction, or for a permit to a church, charitable, veterans, fraternal or religious organization to conduct an auction, the proceeds of which are to be devoted solely to the purposes of such organization.
No auctioneer or his agent or servant shall sell at auction, or expose for sale, or lay any goods, wares or merchandise or other things in any street, road, lane, highway or a public place in the Village of Port Chester unless such person shall first obtain the consent or permission in writing of the Board of Trustees, and also the consent of the occupant of the lot or building before which such articles or any part thereof shall be placed or exposed for sale, under the penalty of not more than $10 for each offense, to be recovered from the seller, auctioneer or his agent severally and respectively.
Any article exposed for sale or sold in any public street, lane, road or highway in the Village of Port Chester shall be removed from the same before the setting of the sun of the day of selling or exposing for sale under a penalty of $5 for such offense, to be paid by the auctioneer, his agent or the purchaser thereof, severally and respectively.
